How about , what do do if the visa is denied ?

Today in Guangzhou China, my fiancee was denied.

Some one there told me that in part was because they did not feel it was a true coupling , rather a friend helping a friend come to america.

I sent photos

i gave instant message logs

i sent phone records

i provided many letters

i gave all i could from what i had

that same someone told me i could try and file an objection to this decision ,, would this be possible ?

and if yes, then how would i start this process ?

any other ideas ?

What was the formal reason stated for denial? It is important to know under what code it was denied so that appropriate information can be given.

Try and keep the case at the consulate. The USC should contact the embassy and DOS immediately.

03/27/2009: Engaged in Ithaca, New York.
08/17/2009: Wedding in Calcutta, India.
09/29/2009: I-130 NOA1
01/25/2010: I-130 NOA2
03/23/2010: Case completed.
05/12/2010: CR-1 interview at Mumbai, India.
05/20/2010: US Entry, Chicago.
03/01/2012: ROC NOA1.
03/26/2012: Biometrics completed.
12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

12/20/2013: Oath ceremony

well the first thing is im not sure what the formal reason was, my fiancee was not given a piece of paper.

But the lawyer who called me said it was due to lack of proof we were a couple.

next you say keep it at the consulate.

how do i do this ?

who would i call to make it happen ?

what is DOS ?

GUZ not 'keep cases there' anymore, unless lawyer can prove up serious and gross error on part of VO.

SHE was issued a piece of paper, you betcha.

Could be a call in letter (white color) asking for more evidence.

Could be a blue slip, asking for more evidence.

Could be a white slip, DENIAL, end game, is over.

A denial cannot be held at GUZ. The normal 221(g) guidelines do not apply at GUZ, they use something else, do something else.

2 years ago, could have it held, submit more evidence.

Your lawyer should know this.

I suggest , seriously, you go back to China, visit with her for 2 weeks, gather more evidence, and then file a NEW K-1 the day after you return to USA.

Alternatively, get married in China , file an I-130 in USA.

But - to help you, we need more detail about the denial ... what does your lass say about it?

Your profile says you filed in the California service center. Historically they do no reaffirm or give a chance to rebut a K1. They usually wait for a very long time and then tell you the validity of the petition has expired and that you can file a new petition. If it makes it back to California don't wait, nothing good will come of waiting, file a new one. Right now have your fiance write down all the questions she was asked and all the answers she gave. It will help you see where she was weak in her answers and what you need to address next time.

This will not be over quickly. You will not enjoy this.

Darnell, i will ask my fiancee again about the paper issued, she "Jiamin" said she got nothing from them.

you suggest getting married in china, but would the next interview also be another chance to be denied even if married in china ?

some things she mentioned about the interview, is one question she got wrong is they asked her where i went to high school.

i have never told her that one. but she got all the other answers correct. like where i work, where i live, how much i make, what mother and fathers names are , etc. she did pretty good there.

some things of concern to them were , since she lives in china, and i manage a chinese restaurant, they thought that was a bit out of the ordinary, and did not think it added up.

others were we told them we talk via internet using a program called QQ chinese program we use every day to talk since it is free. And i took it upon myself to take a few days out of a couple of months and sent them with her, apparently they think i should have sent more.

And perhaps the same with the phone records, i sent the abridged versions that showed how much i spent on international calls, but not the details which shows how many times i called her number.

they also questioned the photos, i have about 2000 photos of me and her and about, and she has them there , but they seem to think we do not look like a couple who love each other in them, we look like friends. what the heck on this, some of the photos show us holding hands, arms around each other etc. none show us kissing heh, i dont take photos like that.

Also some of the photos were of wedding photos, not sure why she wanted pre- wedding photos, but i dont complain much for what she wants. They show us all dolled up in wedding attire. I thought we did pretty good at showing them we were more than friends.

i think they over thought some of these issues, and also Jiamin was not convincing with our evedence.

And perhaps lack of papers on my part.

the most i could have done though was sent more QQ logs, and more photos, and more detail on phone records, but i think Jiamin could have told them , we have more. And how many is enough ? i did not want to send all records, could have cost a small fortune to ship to china. (not to say how much it will now cost me to do again)

but i think we are getting off track of what i need.

you keep asking about the denial.

i need to know what to do next, not what to do about what happened.

Knowing the actual reason for the denial is needed before any meaningful advice about what to do next can be given. No matter what step that you decide to take next (try to have USCIS reaffirm original petition, refile another K-1, get married and file a K-3/CR-1) it will be paramount to address the actual reason(s) that the denial was given.

That's reason right there for a denial.

na - relax you :D China is different - Wedding Studios abound, take a day or two, 11 costume changes, etc etc.

Is NORMAL to get done for couples, regardless of marital status, GUZ knows this, is non-issue.

No paper issued at all? That's really strange, not normal at all.

Perhaps she stuffed it in her bag, and forgot about it.

Alternatively, suggest you email the GUZ IV unit (let me know if don't have the web address for web portal email to GUZ ), and inquire about case status. Sometimes they are fast to answer on this, sometimes is 2 to 10 days.
