If you're worried at all, get a co-sponsor!!! I make enough and was approved by the NVC in March (my tax returns were a little higher than the 125% requirement, but my income as stated in a letter from my employer for THIS year was nearly double the requirement) but when my husband went in for his interivew, the CO asked for a cosponsor. It didn't make our case start over, but it was a heart breaking and holiday ruining delay. Better safe than sorry, get a co-sponsor and good luck!

07/15/08- Married in Accra, Ghana

08/14/08- I130 SENT!!!

08/19/08- Recieved

08/25/08- NOA1

12/27/08- Notice of case transfer to California

01/26/09- Found out all at once that USCIS approved our petition AND sent it to the NVC, got NVC case number as well.

04/03/09- CASE COMPLETE!!!!!!!

10/30/09- INTERVIEW NOTIFICATION!!!!!

12/10/09- Interview in ACCRA!

Co-sponsor needed-NVC approved my sponsorship, USEM required more. :( So sad.

12/30/09- Return interview-APPROVED!!!!!!!!!

01/15/10- VISA IN HAND!!!!!

01/17/10- REUNITED in the USA!!!!!

SO happy to have my hubby here! Sorry I didn't update, once he came, I spent very little time online. The journey is SO SO HARD, but SOOOOO WORTH IT!!!!!

They do not care how many days she has been here or who piad for it. You need to show you have enough income to meet the guidelines to support your fiancee. If you do not, you need a co-sponsor. There is no logic to your thinking, the government does not use logic. They ONLY care how they will collect their money back if she becomes a public charge. They DO NOT care how she will be supported, they DO NOT care if she lives in a refrigerator box and eats dog food, they ONLY care whose wages they will garnish or bank account they will freeze or assets they will freeze. Never, ever, make the mistake that the government will try to reason how you will support her. That is not the purpose of the affidavit of support.

You should use a bank letter showing deposits to your personal account to prove current income plus your last three years tax returns. Alimony makes no difference, they care only about line 22, total income. whatever your bank deposits are for the last 12 months, that is your CURRENT income to claim on the I-134.

This bring to my mind another question, why they ask the 3 previous years for the income tax if they only look at the amount you are going to make the current year? this is my situation now I know my household is for 4 people witch is $27,562 and on the 3 previous years I made way more than that but this present year things have been little slow, but I am going back to my regular job in January if I summit my pay stub only being back on the job for 2 weeks will they consider that salary to calculate my annual income? because I am Union worker and the projects I work for sometimes only last 30 days and than I have to wait one or two weeks to be send out to a different project.
