We are looking into DCF. I , American am married to a Canadian. I have PR in Canada. However, we do not meet the sponsorship requirements. Can my Canadian husband, and I use his Canadian Aunt to sponsor him on the financial 864 or 864a form to assit in meeting the 125% of poverty level? We only have 20K in RSVP.

I belive the sponsor has to be USC since you plan to move to the US ,

and they want to make sure the spouse wont be a puplic charge to the US Gov in the future ,

Lona is right, you are planning to move to america not canada. You have to have a USC sponser not a canadian.

Hi and welcome to VJ!!

Yes, must be a U.S. citizen or PR and must be domiciled in the U.S. to be a sponsor.

The 20k in your RRSP will not be enough, as you have already realized.

You will either have to

- Come up with around another 35-40 k in assets (assets are in USD - so your 20k isn't quite 20k in their eyes)

- Find a co-sponsor that meets the criteria

or

Have the American citizen move back to the U.S. and get employment that will meet the guidelines.

A few questiosn in regards to Sponsorship:

My Sister (USC) has agreed to co-sponsor:

she owns 2 homes 1 appraised at 450,000 and a vacation home appraised at $250,00, as well as makes over

$80,000 per year. She has a family of 3; including herself. Her husbands name is not lsited on either mortgage (homes are not paid off) and she has very good credit. Would this suffice?

Which form is she required to fill out; the 864 or 864A? Should she have originals sent to me in Canada or are email attachments permitted?

Also, should we include my husbands (converted) 20k RSVP?

I appreciate your help with this process. Getting ready; prepared and organized!

Hope someone else will chime in here, as we haven't reached the I-864 stage yet,, but I believe if your sister files her taxes jointly with her husband, your sister will need to fill out an I-864 and her husband will need to fill out an I-864A. They need to fill out and send you original documents (make sure you photocopy them before bringing them to your interview).

Don't know about the RRSP.

Hi :)

You should read the instructions on the I-864 - it's really an important document in this process and it's really important that you understand the form and what is required. Pretty much all of your questions are actually answered there.

If your Sister is a joint sponsor she will not need to use assets. Her $ 80,000 salary per year will suffice (check out the I-864P) she needs to be able to support her family and the immigrant at 125% of the guideline amount.

She will fill out the I-864 - the I-864A is only for household members.

She needs to send you the original of the I-864. For the tax return, transcripts from the IRS and her tax slips or her tax return with slips. Also a few paystubs from 2010.

When your Husband fills out his I-864 - he will not need to include his RRSP as you have a cosponsor, but if you want to, you can.

As to what birdnerd mentioned - technically your Sister's Husband should not have to fill out an I-864A if they file a joint return - however - there has been at least one case in Montreal where the person was asked for this because the joint sponsor had filed a joint return with their spouse, so I think it is a good idea for your brother in law to fill out the I-864A as well.

Just so you know, you won't be submitting this information at your first appointment, when you go to DCF you are just filing the I-130 petition. The I-864 and DS-230 will be requested later, by the Montreal Consulate.
