Timeline

I submitted by i-130 with my maiden name since I had not officially changed my SS card and drivers license. I have received my NOA1 but have finally legally changed my name. Should I notify USCIS that I have legally taken my husbands name now??? I cannot find anything on their website about this.

11-24-2009: Mailed I-130 to Chicago Lockbox.

12-1-2009: NOA1 - California Service Center

12-3-2009: Touched

3-2-2010: Touched

3-3-2010: NOA2 Received text & email

3-5-2010: NVC received case

3-8-2010: called NVC - provided our emails and obtain NVC case nuumber

3-9-2010: Received 3032 & AOS Bill

3-9-2010: Paid AOS Bill

3-10-2010: Emailed 3032 to NVC

3-11-2010: NVC accepeted 3032. Emailed IV Bill

3-11-2010: Paid IV Bill

3-11-2010: AOS Bill shows PAID

3-15-2010: IV Bill shows PAID

3-17-2010: Sent AOS Package

6-19-2010: Sent 230 Package

8-7-2010: Case Complete

9-14-2010: Interview --- APPROVED!

9-15-2010: Received passport & packet from embassy

9-30-2010: Husband will finally be home!

So you are the USC? I dont think it will matter since you will not be the one travelling or receiving the visa.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

What is the name in your passport? I think that's the most important document during the whole CR-1 process. If your name is the same in the passport, I don't think you have to worry about it like Scott mentioned.

But, I would suggest you call or email the USCIS and ask them about this to be on the safe side.

November 16, 2009: Sign-in Failed!!
November 16, 2009: December interviews already scheduled. Operator told me to wait for a possible January interview date. Call back in the 2nd week of December
November 30, 2009: Been trying to call NVC but line busy since late after noon. Finally, got email appointment letter from NVC with the Interview date of January 19, 2010. Yeppe Alhamdulillah>
December 24, 2009: Medical Done and report recieved the same day.
January 11, 2010: Medical submitted at VFS. They asked for: Copy of Packet 3, Appointment letter, and Passport. They told her to take a copy of I-864 and the documents submitted with it, at the time of interview with other proof of relationship documents.
January 19, 2010: VISA APPROVED!!!!!!!!!!!!!!
January 21, 2010: Visa recieved in mail (Package included passport with visa stamped, sealed big brown envelop to be submitted at POE immigration at the airport, and instructions to apply for SS Card)

USA
February 07, 2010: POE Chicago --> Very easy, within 45 minutes
March 02, 2010: SS Card recieved in mail. Welcome letter recieved in mail as well
March 13, 2010: GC Recieved in mail

January 29, 2015: N-400 Application submitted

I dont think it matters since she is not the one immigrating. A call to the USCIS hotline isnt a bad idea, but my bet is that they dont really care about that...it will only be needed later in the process...she is not required to change her name if she doesnt want to in the US.

I don't think you can change your name in the I-130 once it's filed. You can try writing them though (before you get NOA2). That's what I never liked about the USCIS: there's no way to talk with them on the phone like with NVC. The only time you get to do that is for changing address, and they sure won't entertain any other questions.

If you can't get to them, perhaps you can raise this issue with NVC later? But it shouldn't be such a big deal since the visa won't be in your name. The only thing would be the name put in the DS-3032 (choice of agent) and an affidavit of support (for those who file it).

It won't be a big deal at USCIS at all.

I suggest you have a cover letter prepped, send off the court order, to NVC when you submit the DS-230 on your foreign spouse.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
