Hello folks,

I am a naturalized US citizen. My parents, in India, have a 10-year tourist visa that expires in 2014.

I am planning to file I-130 for them soon.

My question is whether they can travel to US on their tourist visa while their I-130 application is in process. Or do they have to stay in India until their I-130 application gets processed. They would like to visit us in May next year, heading back late June/early July. My sense is that the I-130 process won't be completed in the next 5 months.

Also, any feedback on how long it takes to get I-130 processed for parents in India?

Sure they can visit you.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. No problem with visiting you as long as they have tickets to go back to India. The potential problem is overcoming the burden of becoming an illegal immigrant. Having I-130s filed for Immediate Relatives with returning tickets should not be a problem as long as they can show ties to India; home ownership, bank accounts, etc.

I am from India too....Check the timelines here for I-130 process and the NVC process after I-130 approval. For my case it took 3 months to complete the process and check my time line in the signature and also check the below link for specific I-130 progress...

Forgive me for 'piggy backing' on your inquiry but I have a similar question.

My husband has a valid B2 tourist visa. Our 130 was approved and we are awaiting approval on our AOS, which was just mailed on March 16th. We are planning on interning this summer for a NFP in Berkeley where we met last year. My husband experienced no problem at POE last year when he came for this internship, however, we are concerned that he will this June.

He has 'strong' ties' to show: property deed, letter from employer, documentation showing our case has been approved and or interview scheduled (will have by entry date) and return ticket.

Question 1: are these 'ties' strong enough?

Question 2: will his B2 still be valid for travel now that AOS has been (will be by the entry date) approved?

Additional facts:

1: he has traveled to the US before, never overstayed

2: traveled to the UK before, never overstayed

3: had no issue at POE either time

4: traveled to non-EU/US countries without issue

We have planned this summer internship together because (1) we have not seen each other since December (met in Kuala Lumpur for honey moon); and (2) we know all Pakistani men are stuck in AP - regardless - for an unpredictable amount of time.

Please advise on the following:

Strong ties: yes or no - any problems / suggestions?

POE: suggestions / experiences?

B2: valid / experiences?

Documentation to show at POE: sufficient / experiences / suggestions?

Risk involved: strong / minimal / your experiences?

Note: my husband and I have read my posts this forum and others suggesting that it is a bad idea / a risk to travel at this time considering he is married to a USC, me, who lives here; however, we have yet to read anyone's direct experiences. We have never seen a post to the effect that 'yes, we traveled and got turned away at POE for insufficiently strong ties' or 'no, we had no issue and one of us is from the same country as your husband.'

Thanks for your reply. This was very helpful. One question re: I-864.

Does the NVC request that or do we file that on our own? I have received requests to pay both the AOS fee as well as the IV fee.

But I have not yet received any request to send the I-864. I was thinking of filing it on my own but am not sure where I should mail it to? NVC? USCIS?

Secondly, do you fill on for both parents, or separate ones.

I had the same question last month and came here for answers - my parents' I-130 is currently pending and they wanted to visit the US on their 10-year visa. My father just arrived in the US last week, he carried with him bank statements from India, house title/paperwork, and a copy of the I-130 submission (just in case the immigration officer at the airport questioned him). He flew through immigration easily, not a question asked about the I-130 application. Hopefully your parents have a similar experience.
