I have a question. My ex boyfriend and i filled for a K1 Visa in 2008. We never finished the visa cause we broke up. The Germany embassy wrote me that when we do not contact them the petition will be automatically destroyed after 3 months. So that was fine with me. And know almsot 1 year later the USCIS just called my ex fiance and told him the application is still pending. I am dating a new guy we not planning getting a visa at the moment but i do what to fly to the States to see him. Will i have any problems at customs but the visa is not canceled yet?? Please i need some advice.

It shouldn't be an issue.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Your former fiance should write a letter to USCIS withdrawing the petition just in case, give peace of mind for both of you that the petition has been closed.

Since there is only a petition involved, and not a visa, there should be no problem for you. The consulate may not even have received the petition. But if it did, you had only a three-month window to apply for your visa, and if not, then the petition would die automatically.
