Why did you choose K Visa or IR/CR Visa?

My husband's reason for having K1-visa instead.... he doesn't want to get married, then need to be far away from me even temporary. It's our both first marriage (hopefully our last too). He wanted to be with me from the moment we become husband and wife, and never be away from each other for such a very long time.

:thumbs: same here... we dont wanna get married and be apart later due to paper works. also, i wasnt in my home country then....waiting for another visit in my country would eat more time apart to each other so.... yep k1 is the most feasable option for us. we do plan together to come home soon anyway :star:

I couldn't bring myself to ask her to be married for the first time in a strange country with none of her family there. I've been married before and have "mostly" grown girls. My Mother is gone now, I live hundreds of miles from my other relatives and really only have my Dad close by now. I just thought it would be a horrible thing to ask her - to leave all of her family behind and then be married without all of them there for her wedding. There would have been a whole 4 or 5 people at a civil wedding here in the States as opposed to the "how many Filipinos can you get in a 15 passenger van" wedding we had in Palo..lolol :)

I PREFER CR1 VERSUS K1 BECAUSE:

K1- The U.S. citizen petitions to the USCIS Service Center for fiance visa approval,the approval is forwarded to the foreign

U.S. consulate where the foreign fiance lives.The foreign fiance gathers certain paperwork, attends an interview, and (hopefully) gets the fiance visa, travels to the U.S., marries in the U.S. and applies to adjust status during the first 90 days.

Total time estimated: 6-9 months, give or take.

ADVANTAGE:

typically quicker than a spousal visa

• can work upon entry after getting social security card and an EAD. An EAD is applied for at the same time you file for AOS (after marriage). Typical wait times are 90 days to get the EAD).

• May allow for a "get to know your fiance better"period before marriage, since the visa is good for 90 days. If you pursue a spousal visa you MUST marry before you apply for a visa to enter the US.

DISADVANTAGES:

Will need advance parole in order to travel outside the US, will have to file adjustment of status after entry.

• If the relationship fails

before the green card is

received, there are no

other options for

adjustment and the K-1

spouse has to leave the

US.

• K-1 visa recipients are in

valid status for only 90

days and may not extend

their status. K-1 visa

holders should marry and

file adjustment of status

within 90 days after entry

into the US.

• Only U.S. citizens can file for a fiance visa.

SPOUSE VISA:

The U.S. citizen marries the foreign

fiance in the USA or in another country (could be home country), the foreign fiance goes back to his/her country, the U.S. citizen applies to the Service Center for an I-130 spousal visa petition.

ADVANTAGE OF CR1

can work upon entry (no restrictions)

• This is an "immigrant" Visa and will as such allow the applicant to arrive in the US as a permanent resident.

• They will not require an Advanced Parole document to leave the US for travel or require an EAD to work.

(MINUS) Separation from family for sometimes longer then the K-3 or K-1 visa option. Applicant will most likely not be able to enter the US during this time.

We went the K3 route because when we decided the CR1 was slower and the USCIS had not yet mentioned raising fees 60 percent.

We got married in the Philippines because I thought it was the least I could do since she was leaving her family and friends behind to come to the US.

This really resonates with me. Not only did I NOT want to deal with Phil Gov't, but also K1 gives you 90 days to decide if you really want to get married.

The "try it out" or another way to say it...satisfaction guaranteed or your money back... mentality is another reason why the state is (over) cautious and makes the visa process more difficult and lengthy for every1....

think bout this (pls)..with all the illegals we have in america..I dont think the filipinos wud be anything other than a productive member of american society (hard working frugal people with high moral character/family values/spirituality topped with a sustento incentive) and....consider, as well, the number of natural born american citizens living off the system (im not talking bout the 1s that fell victim to recession..u know who im talking bout), yet there must be statistical evidence that supports the need to chokehold american citizens with the affidavit of support. The concern of an additional ward (on top of the many): the state wud rather reject a person that has tax revenue potential than let an american..take for a test drive..change mind and (potentially) hand the non-immgrant (problem) to INS to process out...(thanks for the paper shuffle and not to mention the possible deportation efforts costing us more tax dollars and...c'mon..ez to tago here as long as you stay out of the tax system)..

soooo...with this in mind and having... read many interview posts on this site (and others), discussions with immigration attorney and my senators' immigration liason, read the official CO field manual posted on travel.gov....and speaking only from an analytical, financial and paperwork/time perspective I would choose the cr-1.

My wife and I filed the i-130 and i-129f because we wanted to be 2gether sooner rather than later...for loooooove.....and filed both to let each race the other...the process still took way too long (thanks alot vsc! ur so proficient! doin a great job up there!) but in retrospect...I am happy that we got the cr-1...less paperwork..costs the same...greencard shortly after arrival..social security card even came first..state id's and driver license come faster, able to add my wife to accounts quicker(bank,,investments..etc) and I dont hear many complaints bout bad cr-1 interviews from other vj's unless there were the protocol red flags listed in the co field manual.

and thank you lord I am done calling uscis!!! (for now!)

we choose cr1 coz my husband want to get married in the philippines, and he don't want divorce anymore LOL :-)

we never expect that our papers will be so fast.. we file JULY 17th 2009 and I got my VISA NOVEMBER 15th 2009 -

we request expedited coz i am pregnant, he want our baby born here in the states :-)

and also some said CR1 is the fast than k :-) so its looks it is..
