I was denied my green card 2 days ago (I am assuming). My wife signed a confession under duress saying that our marriage was not entered in good faith. I asked my wife why she signed a confession being that our marriage is legitimate. She said that the officer said that they had proof that the marriage was not real and that the only thing left to determine was the charges that were going to be pressed against her. When she walked into the room they had her mother on the phone. The officer told my wife’s mother that my wife was facing criminal charges and had her crying on hold for my wife to listen. She also told my mother in law that her family business was NOT YET under investigation. The officer also told my wife that she was my third wife and that I am trying to use her to stay in the country. She said "no he has been married once before and I know about it" and the officer said that as a government official he was not allowed to lie. The confession was signed under duress and we want to know if we can revoke the confession and what our options are.

The officer asked her to write a confession and told her what to put in the confession. My wife asked for a lawyer and he said she couldn't get one. She had a bullet point list that she was not allowed to keep. When the officer read the statement he said to put something about compensation otherwise he was going to go to prison. Obviously there was no compensation. She also didn't get a copy of her statement.

It was a very traumatic experience for my wife. We found out that day that her best friend’s fiance had passed away on the same day and we had a few drinks before the interview to calm her down and then they interrogated her mercilessly while her mother was crying on the phone. I was upset at first, but I understand that she was put through a lot. She even threw up when she got home. Please we need advice.

Can we revoke the statement?

PLEASE HELP!

PS: We have an appointment with a lawyer on Monday, but I really want to bounce of some ideas through this forum so that we can have an intelligent conversation with our lawyer

Two questions though, is she your second wife or third? was that true or no?t, I only ask as something had to trigger this off.

Second question, were you at this interview? (AOS I am assuming)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

She is my second wife. I was married once before. She petitioned me, but I did not apply for I-485 since our marriage was rocky from the beginning. She had some psychological issues (been going to therapy for a couple of years) I was not aware of by the time we got married. I wanted to understand what her issues were, but she never disclosed them to me. So we agreed to get an annulment.

It was in Chicago.

She should have demanded a lawyer and not signed anything. This is unfortunate. Hopefully the immigration lawyer can help you on this

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Ok, so what visa did you use to get here? (what are you adjusting from)

Annulment? so your not married now?

and - did you go to this meeting?

Please fill in your timeline so we can have an understanding of what process you went through, what stage you're at right now. You said you are the beneficiary so I'm wondering what meeting is that the USC was required to attend and if you were there or not.

Your wife definitely should not have signed anything and should have demanded a lawyer. Please clarify the annulment situation, was that with the first wife? Was that wife also an american who petitioned for you?

Ok, so what visa did you use to get here? (what are you adjusting from)

** I arrived as an F-1, but I have been here for over 15 years between F-1 and H1B - always legally in this country

Annulment? so your not married now?

** Annulment with my first wife I am now married to my second wife

and - did you go to this meeting?

** I was there but not in the same room. I was in the waiting room for the first 45 min that the officer used to interrogate and intimidate my wife. The officer called me to another room and told me that the marriage is fake and that has already been established. Now he wanted me to sign a statement to confirm this. (same thing they did to my wife) I said that it wasn't fake and that if that was the case I wanted to call a lawyer he said that I couldn't and escorted me outside.

** I got an annulment from my first wife. I am currently married to my second wife. They are both US citizens and they both petitioned me. First marriage i didn't file I-485 for green card because the marriage was rocky from the start. We didn't consummate our marriage and when I confronted her about it she said she just want me to be emotionally supportive and that she had some issues she has been dealing with for years. I said I was not going to stay married to someone if it is not a real marriage and sex and eventually having kids is part of a real marriage.

2nd wife was there for me through everything. We had dated in the past on and off (kown each other for 3 years). After my annulment I moved in with her and we woke up one day next to each other and decided to get married.

Really sounds like you will need a good lawyer to help you with this case.

With what you posted - sounds very strange they would go this way!

I agree, you need to lawyer up and fast. I also found strange that they'd corner your wife that way.

The hell, this sounds like something out of a film.. denied a lawyer and just told to write whatever he says?

Sad and shocking that this kind of behaviour exsists!

Hope you can work through this and everything turns out ok - lots of people here who can give you excellent advice.
