K3 regular route or DCF

I'm a bit confused on what I should do and need your opinions.

My husband and I got married in India in March. In May I moved here to India for a few months to be with him. As of June 1, the DCF guidelines changed to state that those who file directly through the embassy should be a resident here. Well in May I signed a 12 month lease on an apartment, I have a consulting job and received a joining letter with the company and have done a few other things to reflect that I am a resident here. My passport stamps will show that I was here twice in March and left on April 2 and returned on May 23 and have been here since.

I am actually splitting my time between the U.S. and India. I own a business there and a home and have to go back and forth. My question is whether I should attempt to file DCF or just go the normal K3 route from the U.S. Quite naturally I would like to file DCF because it would be faster, however, I don't want to waste time trying to file that way and wasting precious days. I need to return to the states later this week to get my children (who have been here with me) in school.

What is your opinion on what route I should take? Any suggestions would be appreciated. Thanks

Call the embassy in India directly and ask them. Explain your situation in full...they will tell you what to do based on your specific situation and will tell you whether you have the rights to file DCF.

The Delhi Consulate requires that you show the following:

-Employment records in India

-Income Tax statements paid in India

-Police Clearance

-Income Tax Clearance

-Long term visas for India

-Other bill/statements - residential records, utility bills etc

Their goal is to serve US citizens who are permanently residing in India and are strongly promoting that all transit US citizens to file the petitions at their respective US Consulate in the US itself.
