K2 Visa Holder Social Security

Timeline

Hi does anyone have experience with trying to get a social security card for a K2 Visa holder? I went to the social security office a week ago and tried to get a social security card form my Fiancé son and they wanted an EAD Employment Authorization Document issued by USCIS. I am going to marry my Fiancé this weekend but need to have a social security number to add him to the health insurance policy and the school is asking for it also. I plan to adjust their status to temporary Permanente residence but that takes 3 months in Texas and I only have 2 months to add him to the health insurance policy and have dependant life added. I’m sure other people have had this same problem.

Any help is appreciated.

You need to file for EAD with the AOS for the child in order to get a SSN, i had the same problem but my daughter could still start school without it.

Did they accept your fiancees application?

If it's more than 2 weeks before the 90 days they should accept the K2s application.

If you have a different office in your area go there.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

When my (then fiancee) arrived with her 3 kids (Jan 08) and we got married (Feb 08), there was NO requirement for a SSN in order to enroll the kids into school (Kindergarden, 3rd, and 9th grade) or to add them to my health plan (Aetna) at work. They asked for the information, but when I didn't have it they didn't push. You might want to go back and check if this is a REQUIREMENT or just optional information. I would be surprised if it was mandatory.

K2s are not eligible for a SSN until they have an EAD or Green card, yes I have experience with 2 K2 sons.

If filing your taxes you can file the old fashioned way, but not electronically. YES you can claim them as dependents. Your local SS office can give you a letter stating they are not yet eligible for an SSN. In the place for their SSN on the tax form, write "pending" and attach the letters from the SS administration. Put a stamp on it and mail it.

Dakine...K2s are not eligible.

I had NO issues adding them to my health insurance immediately after getting married and no problems enrolling them in school. get a copy of that letter from the SS administration and make a bunch of copies of it, hand it out as needed. Our oldest son (18) even got his driver's lisence doing this. No problems.

My Fiancé was eligable for the social security card but of course they are not able to work until they have the EAD. However the son is K2 status and an EAD is required to have a social security number. They told me that you only need a social security to work in the United States but we all know that everyone wants it to track everything you do.

For tax purposes you will need ITIN number or SSN. Without this numbers you cannot claim them us dependent.

You will not have any problem with school and insurance after you get married.

Yep, you have to get the ITIN until you do the AOS for them and the mother. Went through this before...even had the military write a letter to try and get the SSN...it was a nogo. Had to get an ITIN until the AOS.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.
