The nice lady I spoke to on the phone from the USCIS # assured me after the recalled NOA2 is finished processing with the RFE it will be sent directly to the embassy.

She also let me know the original NOA1 date will be on the new petition with a revised NOA2 date.

I asked about the significance of the pattern of touches and/or no touches and she could not tell me anything. She could give nothing on approval times/estimates. She did say that the I-129F is one of the fastest petitions to go through for the USCIS for what it is worth.

Oh, well, I guess it's good news, right? Petitions will be sent directly to the embassy! Yay! That's what the lady at the consulate told me as well as soon the IMBRA thing started, but it was actually too early for her to be sure.

I only offer advice - not even legal. Just the plain and simple kind.

Hey, Lewis. Thank you so much!!!

Did she tell you if there´s anything yet to be done regarding the recalled petitions? I mean, if they can simply reapprove it after the RFE or if they still need more instructions to dela with the new and correct noa2 date?

Also, I think rene, the only reapproved case we have so far, mentioned that her case was going home through NVC...

Rene, correct me if I´m wrong.

Again, thanks a lot, Lewis.

Oh, yeah, thanks, Lewis! :)

I think we should PM rene - with the case approved I bet she won't be coming back too often to check on the IMBRA forum.

Yes, like my disclaimer says, it all opinions here. She said as soon as the petitions are processed, they will be sent on to the embassy. We have all gotten misinformation from the USCIS at times, I hope this is all correct. She did not mention anything about "extra processing" due to the new NOA2 date. She said since the petition was already approved, once the RFE is processed the petition is ready for the embassy. It seems easy enough, all they have to do is put a new NOA2 date on our previously approved petition. I think this one petition that has been "approved" has thrown a wrench into the works for us all, it does not seem like it was handled like any other case.

That's what I recall Rene saying - that the written notice (new NOA2 with new expiration date) she received said approved petition was being forwarded to NVC, just like the first NOA2 says. Kinda makes you wonder if somebody screwed up on Rene's case. I hope not, but it would sure be better if they don't wast another 3 or 4 weeks sending the reapproved recalls back to NVC, getting logged in to their system again, etc. I can't really see why it would be necessary to send them back to NVC. The case numbers have already been assigned, proper embassy/consulate identified, etc. What would be the purpose?

2/28/06 - K-1 app sent to NSC

3/06/06 - NOA 1

4/24/06 - fiance received instruction pkt (pkt 3)

5/05/06 - pkt 3 checklist returned to embassy

6/26/06 - email, RFE sent

7/05/06 - RFE received and sent back to CSC

7/06/06 - RFE received, signed for by receptionist at CSC

You're right Rene did say that in this thread:

http://www.visajourney.com/forums/index.php?showtopic=22319

I just hope what I heard today is correct, if not, it wouldn't be the first time I got incorrect info from the USCIS.

Well, either way, I don't mind waiting for it to be forwarded to the consulate or embassy at this point. I will throw a party and shout "approved!" out of the window when they approve the RFE and send us another NOA2, NVC or not. We've been waiting for months, a few extra weeks won't hurt. I guess.

I also don´t think sending it without NVC means it would be necessarily faster.

First, they might wait and gather all petitions from each country to send it together.. (this is just a thought)

I think they do work in batches...

Also, we know that once the case hits NVC it doesn´t stay there for very long.

My case got in Brazil in a week.

God knows how the Service Centers will mail it..! The RFEs took a while.

But it could all be nice and smooth.

Approving RFE, sending the case back to the Consulate in no time. Think about it. Why not?

Maybe it wouldn't be wise for the service centers to send it back to the Consulate directly. Since it isn't something they normally do. Could they be trusted with something like that? I am all for it getting back to the Consulate as soon as possible, but I am a little worried something would get screwed up if Vermont had to do another thing that they are not "trained" to do.

I am very curious to see what really happens. I just hope it goes quickly and without problems!

I just spoke with representative Van Hollen's office and they also said they believe the recalled petitions will bypass the NVC. I asked about the significance of the NOA1 date and they said there really was none until this mess gets cleared up at the USCIS. They also said once the RFE is processed and the case is ready it will be sent on to the consulate. Hopefully, by tommorow I will get more info from my senator's office.

Thanks, Lewis, for keeping us posted. Well, well, well, let's see how they'll handle our petitions sending them straight from VSC to the consulates.
