You will not need that - the two forms are seperate (with seperate fees). You may just muck up this application.

Follow this guide if you haven't all ready.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

you would have gotten a letter about payments, prior to actual denial.

Did you move? USCIS notices are NOT forwarded to new address, ever. There's a clear statement on the envelope that states that, as well.

if you came in on K-1 visa, thats the right fees.

If you came in on tourist visa, well, sorry, not enough forms, not enough payments on the other fees.

That is not true. We moved and even changed our address with USCIS but they still sent my husbands greencard to the old address and it was forwarded.

I really do think that was unusual, Dillon. You got lucky.

I would send the pakage again with ONE personel check of 1010 $

like bobby said this is why it got rejected , the amount was incorrect its 1010 not 1080

( with personel check you can see when it gets cashed on your bank account ,

it doesnt matter if you or your wife signs it , as long as they get the right amount )

i just read guide . I didn't kno that i had to get a k1 visa in order to get married... i've had my b1/b2 for a while now. it didn't occur to me that i would have to get a new visa just to get married.

i'll just wait for that letter from uscis and see what they say

Then you were VERY VERY LUCKY. I mean, in the 1/100th of 1 percent lucky.

You're the exception - go forth with pride !! (and I mean that, sincerely )

Change of Address is a PITA, always.

Back to the OP.

Rejected for fees is easy thing - just make sure you know which set was rejected (I-130 or I-485) - then resubmit a new set of documents (if you want to save time ) along with the proper fees. You might get 'that entire packet' returned to you, but it won't be 'so quick' .

If you made copies of everything, prior to filing, then you should be ok, just some extra work.

I'd be more worried, really, about getting married 2 weeks after coming in on a B2 tourist visa, though. Some adjudicators think this is sure sign of visa fraud.

Maybe you read the guide but i dont think you read what people are saying. You payed the incorrect amout. The AOS fee is 1010$ NOT 1080$.....

You over pay so they are refusing it and requesting you to send the correct fee.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

the K1 does not aply to you since you are already married , k1 is a fiance visa

I asume you came with visitor visa with no intend on getting married when you arrived , then got spontainiously got married ?

if thats the case then you are doing the right thing with I 130 and AOS and you have to prove you didnt have any intentions of marriage when you came here ,

if you had intentions of marriage when you came then you will have to go back to your country and aply for spousal visa .

, only thing read the instructions on the AOS fees carefully

cose as the notice sais you got rejected for incorrect fees ,

BE WARNED:

You must qualify to file for an I-130 in the US. Not everyone does, and in some cases doing so can be considered fraud and result in being deported and banned from re-entry into the US for a period of time. If you attempt to file and you do not qualify your legal status in the US can be placed in jeopardy. J1 Visa holders will almost always require a waiver and should consult with an immigration lawyer or the USCIS for more information. If you have any doubt, consult an immigration attorney.

If your fiance/fiancee came to the US on a tourist visa with the intent of immigration and marriage, and you are not yet married, then he/she should return to his/her home abroad, and the K-1 visa should be filed (using an I-129f) instead of the I-130 to avoid a denial, deportation, or even being banned from re-entry to the US.

If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

The above conditions are serious and can result in the separation of families for many years if not taken seriously.

I've read your timeline, I think you have other problem :(

You did not file I-485 set AND I-130 set, together. IMO, this fees problem is gonna be minor, compared to other things that might crop up.

It seems pretty simple to me - the solution anyway.

The filing fee for the AOS/I-485 is a total of $1010.00 - since you're sending money orders, you're probably having trouble getting one single one for over a $1000. My suggestion is - buy one money order for $930 and another for $80 (which will total $1010). The sooner you do this, the sooner you'll be back on track.

If having trouble with the now already purchased money orders - just re-submit the original money orders for $1000 and $10 and cash the one for $70.

his timeline doesnt show future problems ,

if he can prove that he got married out of the blue and has evidance that suports this

( like emplyment letter that he was do back to work at a sertain date , or open lease or anything that proves he was expected to travel back to his country )

he didnt break the law ,

he only broke the law if he came here with intend to mariage and stayed here and files for AOS .

like I and many here said before the rejection sais incorrect fees ( 1,080 IS INCORRECT 1,010 IS CORRECT )
