Can I activate the visa at POE and come back to TO?

Hi everyone:

We have very personal situation where we might need to stay a few extra months than planned in Toronto once we get our visa.

Since CR1 visa needs to be activated within six months,can I just go to the closest POE,enter the US,activate the visa and come back to Toronto the same day,stay a few months more here and permanently go back to the US?

If we can't do this,I'm afraid we will have to re-schedule the interview which I really don't wanna do it.

Has anybody needed to do this?

I would appriciate for any help.

I wouldn't reschedule your interview! I've read some stories about it taking forever....I know you have a certain amount of time from receiving your visa to getting it activated. I actually crossed the border, activated my visa, picked my husband up at the airport and then a couple of weeks later crossed again like it was nothing (had my green card in hand). I'm not too sure what the 'rules' are.

Then,you've already done what I'd like to do in my circumstances which means it's doable..

did they ask you as to why you went back to canada after the visa activation...did u need to do anything extra etc...

Hi redblue,

Yes, the reason I asked is because if he was living in Canada then it wouldn't be allowed, however what you are planning sounds fine.

Shouldn't be anything wrong with what you are planning as long as you are only going to stay a couple more months.

I did almost exactly what you are talking about. I went to the POE at Pearson Airport and went throught their process on a Friday. I stayed with my wife in the States for the weekend and flew back home. That was in March. I didn't move to the US until June.

then,when i want to cross the border again after 2-3 months,most likely i wouldn't have my green card yet...do i need my green card in order to cross it the second time ....I'm guessing yes since i wouldn't have the sealed envelop anymore...

how long does it take to get the green card?

In ur passport is the I-551 stamp----picture of you,states the visa type, etc etc, takes up a whole page of ur Cdn passport! When you go and activate it at the POE,they put an ink stamp on it-- it is good for ONE YEAR!!! You use that until ur green card arrives, which usually takes around a month or so.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I also returned a week and a half after my POE at the Peace Bridge mid-June of 2009. I was in Canada for two days and on return to the US (using the I-551 stamp as my temporary green card) I was questioned (somewhat rudely I thought) as to why I had returned to Canada so soon after my POE. I explained that I had returned for my son's graduation and they were okay with that. I then returned a month later for a week (had my green card by then - 30 days after POE) and had absolutely no issues returning to the US.
