Denial decision notice from USCIS while waiting for interview

I just got an e-mail from USCIS that they just sent a denial decision notice on my I-824 application. How can that be? They have already approved everything and forwarded to the NVC. I don't understand what this is. It's too late to call tonight but I was wondering if this has happened to anyone else. How could we get a denial decision from USCIS after the case has already been forwarded to the NVC and been completed? If this is going to cause us to have to redo everything from the beginning I don't know what to do. This has gotten me seriously worried! What the heck do we do now?

So sorry. Don't have any advice.

Have you called NVC to see if they can tell you anything?

I just went through all our documentation and realized this may be regarding the K-3 approval that was abandoned in favor of the IR-1 because they were completed/approved at the same time. Could this be? I haven't called the NVC yet but I'm doing that right now...

I'm not sure. Call NVC and see if they can tell you anything.

Have my fingers crossed for you.

You said it's a denial on the I824. That is a document that is used to make action happen on another case, like a CR1. It would be denied because USCIS no longer has your case since it has moved on to NVC.

We received notices two notices back in July stating that our application was approved and decided to abandon the K-3 process and continue with the IR-1. The NVC notified us that all the necessary documentation was received and our case was completed Sep 24, and we've been waiting for the visa interview date in Montreal since then. I just don't understand how we could get approval notices for everything and have our case completed at NVC and then receive a denial notice three months later.

Int, reread my post. The I824 has nothing to do with your actual petition.

Application for Action on an Approved Application or Petition

Purpose of Form :

To request a duplicate approval notice, to request approval notice to another U.S. Consulate, and to request notice to a U.S. Consulate for derivative visas to family members.

Oh man I am so dumb! It's the I864 affidavit of support I was worried about. The I824 is irrelevant then since it's already at the NVC and completed. It must just be a denial notice because it's already there and completed. Thanks so much for "tuning me in" :) I was freaking out there for a bit. I'll pay more attention next time :)

If you have 'case complete' on an I-130 at NVC, within a certain amount o time, it's supposed to go to the Consulate.

Call NVC, get a human, ask for status on the I-130 petition.

Then, Call DOS , get a human, ask for status on the I-130 petition.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I've been busy with work and haven't gotten a chance to call USCIS but I did get a hold of the NVC. They told me pretty much what I expected, that they have no information on anything to do with USCIS. I'm sure the I824 was what they called "denied" (I'm sure just to make it sound scarier :) ) because the info has already been sent to the NVC. When I originally filed the I-130 my wife was with me for an extended visit and I mistakenly filed the I-130 with her current address as mine. When the I-130 was finally approved we filed an I-824 to have the case forwarded to the NVC, because her address was still listed as mine in the US. Either we were just naive in thinking that was necessary or it was and they sent the info to the NVC without even looking at the I-824, and by the time they actually processed it, it was unnecessary. I'm just guessing a bit as I haven't talked to a human being at USCIS or received the "denial notice" that supposedly lays out the details. As far as the NVC was concerned our case is still waiting for an interview date in Montreal like it always was.

I received the "denial letter" in the mail today. It's what I expected (after calming down after initially freaking reading the e-mail :) ). They explain in actually fairly good detail that since the case has already been forwarded to the NVC, the I-824 was denied, implying it's not necessary. Of course no mention of a refund but oh well live and learn. Here's hoping for an interview date in January!
