Well, i got an RFE. I screwed up and didnt send the court rubberstamped copy of my divorce decree. Well, the USCIS never updated my status telling me that I had an RFE. I am having all my mail go to my home where my friend is staying. I am deployed to Kuwait. He finally found the RFE and it says that I need to send that letter with. Well, I dont have access to the letter. I am hoping that my friend can scan a copy of the letter and e-mail it to me tomorrow so i can send it out in the mail and hopefully it will get there before xmas (my deadline according to the letter).

The last action i was showing last night online was 24 November. When i did another expedite request they sent me an email saying that there was an RFE on 1 december sent. I called the USCIS after that again and told them that I didnt ever receive it (i couldnt get ahold of my friend) so they checked to see if it was returned. They said it wasnt....Then they said they couldnt send another copy. I told them that if it got lost in the mail then it would have never been sent back. So the lady finally decided that she could send an e-mail to request another RFE letter. I got an email this morning also stating that my case was updated online with the RFE dated 1 december.

So, for those that have had an RFE, is it manditory that you send the letter back with the evidence? I am assuming it is. I am just going nuts here because now I will have to depend on the mail service to get the info there in time for xmas. I am at an APO location, so hopefully with me requesting another letter and getting my stuff postmarked from here they will give me a little extra time to submit the paper. Luckily I do have the stamped copy of the decree here with me.

I feel better now that i have vented some.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Sending back letter of RFE is just easier for them to I.D. your case, if you cant send back original, use a copy, BUT explain why your sending copy. Explain your military, etc, etc.etc. and if they cant understand that, well shame on them!!!!

That is what i will do..i was going to type up a letter with it. The mere fact it will be sent from an APO address should be good enough. I will call the USCIS again tonight (from here) and make sure It is documented that I am still waiting for the RFE letter and hopefully them sending out another one will automatically extend the deadline...but I want to make sure. I am still waiting for the email from my friend. Hopefully he got it scanned and it is waiting in my work e-mail.

Well, i got the email from my friend with a scanned copy of the RFE. The RFE was dated 25 November 2009. I guess you only get one month to reply on these things. I will call the USCIS military hotline again tonight so that they can hopefully extend that out. I sent the required stuff and I was told 7-10 days for delivery. This is really nerveracking..... I did get delivery confirmation put on this one too. I will wait about a week and call again...the monday after Christmas.

Hmmm Checked the site today...says it was touched. Said on 23 December they sent out an RFE. I'm hoping it is the duplicate of what I had before. Although it has been a week since I called them and told them to send another copy of the RFE because I didnt know if my buddy was going to be able to find the one that they originally sent. I am having my buddy keep an eye out for it when it comes. Hopefully it will be the same thing as I already sent into them. Just waiting for the delivery confirmation on the one I just sent so I can call again so they will check on it.

Timeline

First, thank you for serving our country and good luck with your expedite!

If you don't mind, could someone clarify this please? You got an RFE from the USCIS? Not the NVC? I'm asking because I don't know how it's handled when a visa case is expedited. Also what puzzles me is I thought USCIS accepts photocopies of all documents they receive. It's NVC that requires the originals. Or does this policy change when USCIS expedites a case?

Another thing is, how do you get ot talk to a USCIS person? We could get a human on the line only if it was for change of address! But we could always talk to an operator at the NVC.

Good luck! We got an RFE too so I know how frustrating it is!

Yes you can send copies of everything to the USCIS, but they can request the originals at anytime. Also being that it was my divorce decree, they wanted something stating it was filed with the court....they could have called the courthouse and verified the case there, but of course that isnt their job. My problem was that I didnt copy front and back (back is where the stamp was). Dumb mistake and I also put the stamped one in the wrong pile. I did get the RFE from the USCIS as it was after my NOA1.

As far as getting to talk to a real person at the USCIS, I called the military line, so I have an option to talk to a live person....of course I have to go through a couple of prompts, but I can talk to someone. I think that is the difference.
