Easier to go to Canada ?

Timeline

I was wondering if anyone out there knows anything about this ?

I know a few years ago that if you were married, you could bring your American husband over the border to Canada, go into Immigration and be able to get a Temporary Visa so that he could live here with you for 6 months, while you started apply for Visas for him to live in Canada peramently. Does anyone know if this is still possible ? Can he bring all of his personal belongings with him ? We eventually want to move down South to a warmer climate, with him being an American would we be able to move back to the USA ?

Any help or insight that would be greatly appreciated.

Hi,

Yes, this is called an inbound application (to Canada). You should contact the CIC call center for details of this. It's not all that much easier for him to immigrate to Canada - it will cost you about the same and probably take a year or less - however they do allow you to live together during the process - so that's the good part.

Once he has lived here (in Canada) for a while, you would actually be eligible to file directly at the U.S. consulate for you to immigrate to the U.S. - currently the processing time is still several months. Something to consider - since you will both be in Canada when you apply to move to the U.S., you will have to prove he is intending to reestablish domicile in the U.S. - that he has employment income or assets to support you (and you cannot use Canadian income for this purpose - so you may need a cosponsor).

Anyway, that is a very very brief overview. Road to Canada is the forum for Canadian immigration, however CIC has a really good website and call center and I would recommend that you call them first and get your information there directly.

Their number is 1 888 242‑2100 and they are open from Monday to Friday, 8 a.m. to 4 p.m., your local time

While I often agree with TM - the CIC information line is full of bad advice/information. I would suggest using the CIC website as it is full of information and answers.

I did an inland application three years ago and I've had my PR for just over two years now. Our application took 14 months.

You can be in Canada and apply as an Outland App. I would highly recommend it as it is faster. You just send your paper work to an office in the US. Our inland application took us 18 months and we just finished it Oct of this year. Outland Apps average 6-8 months.

Our inland application took 6 months, they must be slowing down :lol:

The thing is how can your spouse stay here legally for whatever period it might take to do the application (I mean if it takes 6-8 months ok - but what if it drags on longer?). Plus you are supposed to declare at the border that is your intent andddd it has the huge downside of the spouse not being able to work while waiting.

It took us alone 10 months for him to even get his work visa. =( I guess everyone's experience is different. Mind you the lady at the immigration office told us of these shortening tips we should have been doing. lol.

oh well. by the time we were half way done we were wishing we did outland over inland.

Opps sorry 9 months for work visa. We started in April 2008 and got his work visa in January 2009 and got his PR card in Oct 2009. :blink:
