HI everybody... wow seems most everyone has own problem bout processing K3 visa...

i need your help. please...

i married USA citizen bout a month a go in my country. before we apply for visa to embassy, we had found info saying that the k3 visa able to be processed in my USA embassy. but when we called, they said that they can't process there.

anyway, they said that we have to send all paper work I-130 form to USCIS in Chicago. after that, we will get receipt I-797 form that must be given to embassy here and able to process the k3 visa. after that we will give paper work of I-129 (with receipt I797 form) and they will give us a list of hospital to do medical check up also interview schedule. the good news that, if i get interview, probably i will get my K3 visa. but we have to wait at least 3 MONTHS!!! wooow... such a long time to wait.

my questions:

1. how long does it take to get k3 visa outside the USA ?

2. can I get my visa faster?

3. is there couples like us whom has the same thing like i do now?

4. after get receipt from USCIS I-797 form we send to NVC (National Visa Center) or to EMBASSY here??? cause i kinda confuse... :wacko:

pleaseeeeeeeeeeee..... help me i need friends to share :) thank you everyone and visa journey ...

No you cant get the k3 visa faster but the k3 is more expencive than a CR1 and its possible you could get a CR1 faster than a k3.

No visa is fast.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Which country are you from, and does your US husband/ wife live with you? If they US citizen has lived in a country legally for 6 months, you can do DCF- ie get the visa directly from the embassy. It's a CR-1 visa, not a K3, that may be why the embassy told you to send it to the USCIS in Chicago, or because your US spouse is not legally resident in your country. If you do DCF, 1-3 months is about average (see my timeline below for an example), and it is the fastest way to get a visa for a spouse.

If your US spouse is back in the USA or not legally resident in your country, you must file via USCIS Chicago. The process takes longer then, 6-8 months if there are no problems. The K3 can be a little faster than the CR-1, but only a few weeks and the CR-1 is the better visa as you get a greencard immediately upon entering the USA (ie you can work etc), and is cheaper.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

First of all you will receive TWO I-797's.. The first one is acknowledgement of case filing and the second is petition approval (for each petition submitted). Simply taking either of the I-797 to the embassy is not enough... The embassy needs the physical APPROVED petition file before they can do anything....

For a K-3 the embassy needs the approved I-129F petition which you do not mention having submitted (you only mention the I-130). Without the I-129F petition approved there is NO K-3 visa possible
