I filed myI-864 AOS right before thanksgiving weedend...I claimed two kids on my income tax and including myself. I made $22,390.41 for 2008. I am filing for my mother and my husband but just recieved a letter from the national visa center saying that i didn't meet the poverty guidelines. For a 4 people is $27,562.00. Well, i have a friend who is willing to help me but he makes $21,000 for 2008. He didn't claimed anyone on his income except for himself. Can my friend help me to be the joint sponsor or do i need someone else that makes more money? Can someone please help me? I am confused and all stress out!!!!

The joint sponsor claiming himself and your husband would need to make 18,212... So he should work... Of course, If you have someone who clears more, that would be better, but he should be OK...

Yes, so if you are petitioning for your husband and your mother... The co sponsor would have a household of 2 (you husband and mother) plus their own household size.. If the co-sponsor is just 1, then the total for the co-sponsor would be 125% above poverty level for 3 persons...

Christeen,

I have a friend who's willing to help me for my mother but he claimed 4 people including himself...so, the total will be 5.For 2008 he makes $29,582.00 and on his 2007 income tax return he makes $28,795.00 but he only claimed 2 people including himself.Do you think he can help me for my mother? Another thing, he doesn't have his W2s for 2007 but im positive that he can get it. your advice please.

They will look at 2008 and what he earned and MOST IMPORTANTLY... what he is earning NOW... IF he currently claims 4 plus your mother would be 5 then I am sorry to say he does not earn enough... The 125% poverty level for 5 people is $32,238... I think you might need to shop for another co-sponsor with more $$ or fewer dependents...
