Fiancee visa for third time

Timeline

Hi there...the last 3 years I got 2 fiancee visas. The first time my fiance wasn't sure about marriage so I came back home. the second time we got married but the marriage lasted for only couple of months. I had my change of status interview in february but I left the country before I get the greencard since then I've never heard about USCIS anymore. Only 2 weeks before I leave I met an wonderful guy who came to visit in my home country this month. We want to start another fiancee visa process since I'm legally divorced now. Will I have any problem asking for it? My boyfriend hasn't done this before. Please I need some helpful information. :blush:

If you both meet the requirements, by all means, have your new boyfriend file.

I would be certain that your previous visas will come into question at the interview - so be prepared for that.

However, you may want to take a step back and let this relationship mature a bit before going through this process for a third time in as many years... (just some humble advice)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You guys are "good to go". You should know how to do the process by now. Shouldn't need much help.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I would be certain that your previous visas will come into question at the interview - so be prepared for that.

01/14/2009 - Flew back to Brazil ;(

02/10/2009 - Hubby flew to Brazil ;)

09/23/2008 - I-130 sent

11/06/2009 - Interview in Rio de Janeiro - CO need an Advisory Opinion (sent an email to DHS with my I-94 and court order)

12/02/2010 - Hubby went back to the U.S.A ;(

Wow, you're the first I've heard who went through all this two times! After your divorce and AOS interview I believe you could have petitioned to stay on your own. But that's water over the dam now. You should be fine to try again. Good luck with number 3!

23rd June 2008 2nd trip to USA, returned 26th August 2008

22nd June 2009 3rd trip to USA, returned 20th September 2009

10th November 2009 I-129F package sent

17th November 2009 package signed for

12th December 2009 RFE(???) for CERTIFIED Divorce certificate, still not got NOA1

14 December 2009 TOLD OUR PACKAGE IS BEING RETURNED FOR INCOMPLETE DOCUMENTS - THERE GOES OUR TIMELINE BY 2 MONTHS

27th January 2010 STILL waiting for an NAO1!!!!! Packet was sent to someone else with same name and never returned, weather caused delays, telephone helpline ppl just keep saying to phone back as we have to be reassigned a new number. Argh!!! We should be approved or denied by now!!!!!

My advice is the same as Bobby's. Perhaps some more time to get to know him better is in order, as you are about to embark upon a THIRD fiancee visa in TWO years. :unsure:

I would be extra sure you and your fiancee have TON of information for the interview. I wouldn't be surprised if you have a very hard time convincing the officer at the interview that this is genuine.

Things often work out like that, you think someone is great and then reality sets in.

I think you would have to take this one extra slow because even if you didn't violate any

immigration or visa laws or regulations, they will have you down as as "serial filer"

wich in and of itself is one very serious strike against you. Your innocent bad luck would

be to them like a major conspiracy. You have to prove that otherwise by documents,

documents and more documents to give creedence to your actual relationship.

Documents over time, that is.

your bridge could be an aquaduct of course in which case you'd be right, lol

to the OP, I'd advise that you take your time and be certain about the relationship this time before going ahead. it may well be the real deal and the two of you could be made for each other but to someone on the outside looking in, it does raise a red flag that this is your 3rd visa in as many years. think to yourself how much time have you spent physically with this guy and is it long enough to know you can live together day-in-day-out? Good luck.

I agree with Marina, you'll have to convince them this is for real, and will probably be questioned a lot about the previous 2 visas.
