This is my situation: Filed for a K3 visa had interview on the I129 in April got put into AP got called back into the embassy yesterday for another interview on the I129, which got approved....YIPPPEE!! However, while we were waiting to be out of AP (8 months) we went ahead and paid the additional fee of 470.00 for the I130, which turns it into the IR1. The NVC approved the I130 and scheduled an interview date for January 22 at 7am. I was hoping when Ademola went for his interview yesterday they would just do the IR1, but the NVC hadn't forwarded on the documents needed to complete the case which is why they did the K3. I'm not sure if we should wait and go to the interview and just do the IR1 or we should just forget it (lose the 470) and do the adjustment of status here. This would also mean he wouldn't be able to get a job until the EAD is approved, which you have to have an active AOS filed. I worry that there is a risk that they might not approve the IR1 even though the K3 got approved. Has anyone heard of this happening? Does anyone have any words of wisdom or advice for me......it would be greatly appreciated!! Thanks

If you have the chance to get the IR1... it is the BEST visa as you get the GC when you enter for 10 YEARS!!! That means you get the SS#, can get the Drivers Licence and work when you enter and NOP ADJUSTMENT OF STATUS... Don't worry bout the other $$$ as the K3 would cost you $1010 plus the filing fees!!!! For 1 month (since your interview is the 22nd of January) without a moment of hesitation I would trade that wait for the IR1... No questions!!!

someone said that I could risk being put back into AP again for the IR1 and that by going to the interview regardless of the outcome it could cancel out the K3 visa. Does anyone know if this is true or not?? Please remember I am also dealing with the Nigerian embassy......

I would do the IR-1. Knowin gyour situation.

Did he try to speak with the embassy about the IRI. For clearification of what would happen.

OH and its about freakin time. Congrats. *wink

He has the visa for K3 which means he could travle whether he is put in ap or not for the cr1. I am thinking.

Alls I can say is getting the IR-1 is like getting the gold ring. Worth waiting for BIGTIME.

After what I/we went thru with the K3 once my wife was in the US I wish we'd waited at least for the CR-1.

If getting the IR-1 had been at all close we'd have waited for the IR-1.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
