our RFEs for AOS.. please help

we just received our RFE letter in the mail, and it asked us 3 things for the initial evidence

1. "Submit properly completed and signed FOrm I-693, Report of Medical Examination & Vaccination Record for the applicant on form I-485. The medical exam must be conducted by a civil surgeon who has been designated by UISCIS. The medical must be issued less than one year prior to the filing date of Form I-485.

a. vaccination sheet- we had a civil surgeon from our area update my vaccinations& transcribe my vaccination records, sent the sealed envelope with all our other documents.. but they still asked for it..

(I am going to talk to my civil surgeon about this and ask for another sealed copy, hopefully they don't charge us another $160 just for the transcription!!)

b. medical exam- at POE i handed to the IO my packet from the US embassy and i know it contains my medical results from my country but I don't know why USCIS sent me an RFE for it

my options:

(I called USCIS military hotline and the woman said, to visit www.cbp.gov and maybe try and trace where my document is)

***we could do another medical exam but then aside from the fact that it's gonna be costly, I can't afford to have another x-ray.. ( i had one for the K-1 medical, then another one for military since my PPD was positive) maybe I can just show them my CD from my medical in the philippines and my recent result from DOH here in PA..

2. SUbmit a complete Federal Tax return submitted to the IRS from the petitioner/sponsor on form 1-864, affidavit of support, for the most recent tax year.

we had submitted his W-2s for 3 yrs, 2006, 2007, and 2008

he's military and he said that was the only thing he got from them.

so i dont understand either why they want federal tax returns.. we only have W-2s.. or is that the same thing.. I'm clueless about this.. as I have never filed for anything involving tax ever so bear with me on this lol :blush:

3. The petitioner's income on federal income tax return does not meet or exceed 125% (100% if military) of the poverty guidelineThe petitioner lists their current income on form I-864 as an amount to be considered as sufficient; however, no evidence has been submitted as proof of current income.

.(He was deployed 2007-2008; he was tax-free and then changed duty stations and for some reason his w-2s for year 2008 shows an adjusted annual gross income which was lower than the 125% but he earned so much more than the poverty guideline..(and i think everyone in the military knows that) HE IS STILL FIGURING THAT OUT FROM LEGAL why his supposed income was only that figure because even his superior did not understand why some information on the W-2 of 2008 (the social security wages )showed to be more than what he had earned..

with that last part, we will just send His LES since jan-december 2009. so that will take care of the evidence for current income...

so right now, this is seriously just overwhelming.. I am not sure how to handle that whole thing with the medical .. if someone has had the same experience do share what you had to do..

I really just want to be able to get thru this RFE.. and we only have 87 days starting dec.4

all the different colours and font sizes make it kind of hard to read...

Being military does NOT excuse him from filing his taxes.. yes the military gives him w2s but that is not your taxes you have to send the tax return for 2008. did you not include pay stubs and a letter from the employer? Its just like filing for the initial petition you have to include all of these things not just the w2s.

w-2s are not 1040s.

If he can't find them, request tax transcripts from the IRS.

re: medical - sometimes the sealed envelope doesn't make it to the right desk after POE. It's not lost, per se, just not 'pulled' properly. If, as you say, all they need is in the envelope, then they need to find it. You can do two things on this: 1) cover this topic in a cover letter back to them oe 2) get infopass appointment, talk with human face to face, have THEM find your medical packet.

re: the advice from the military liason - I'm sorry, that's just funny, in a sad way. You got the moron , on that phone call. Try this phrase if you get him again? 'I'm sorry, the answer you gave me, last time, was not only woefully inadequate, but wrong. Is there a supervisor I can talk with? I've wasted 10 days going by your guidance'.

if you submitted most of the docs they're asking for, it means that they either got misplaced or lost (or sometimes when person in charge doesn;t see the docs right away, he/she presumes those not submitted)

in any case, since it's a big hassle to gather the docs again, the best thing to do is info pass

well, ive talked to him about the tax returns.. he said he has turbotax do all that for him so we'll check it again.. and yes, we did fail to think about the pay stubs, His LES..

but also about the medical thing, I actually also called in the cbp, and i tried to talk to them if they can try and see if my K-1 packet was sent, they said they cannot look that up because they send everything the next day right away. So That was a big help.

i called my civil surgeon again who my gosh charges an arm and a leg! they charged us $160 just for the transcription. ,I asked if i could have a nother copy of my vaccination, the guy was beating around the bush, he wants to see the RFE letter. and when i read it to him over the phone, he said i might as well get a medical since the letter says that and that the issue wasn't because of vaccination records.

I asked him how much it will be for anothermedical without the X-ray plus the copies he said it would be another $150.. but when we get there to the office I am so sure there will be more fees. HE said talking to me on the phone was one of the reason behind the fee..

so I am sooo upset about USCIS why my medical exam is not there, or regarding my I-693 vaccination.. I do not want to spend so much money again on people like our civil surgeon who charged me sooo much just because they know I need to do this.

ok well thanks so much, I had thought of that too.. coz when i had my biometrics I asked the lady in charge at the Application Support Center for USCIS about RFES (i ddn't know what mine was just yet so I asked about that instead) and she explained to me instances regarding RFEs and she said they do that all the time, the I-693 gets lost.. yes, she actually told me that, and she said the only thing I could do was submit a new form.

Hello, I told you in my email that possible your RFE is I-693, same as what happened to other November filers without knowing the exact reason for it.

I also have the I-693 RFE but my responds was another transcription and not full medical but I am not sure if they will able to ask another I-693. I talked to the USCIS costumer representative and he told me that I do not need a complete medical.

Those who just sent the DS 3025 also received same RFE letter "Submit a properly completed ans signed Form I-693..."

Hello, I told you in my email that possible your RFE is I-693, same as what happened to other November filers without knowing the exact reason for it.

I also have the I-693 RFE but my responds was another transcription and not full medical but I am not sure if they will able to ask another I-693. I talked to the USCIS costumer representative and he told me that I do not need a complete medical.

Those who just sent the DS 3025 also received same RFE letter "Submit a properly completed ans signed Form I-693..."

Hope everything will be well to our documents.

yeah i have called USCIS about my medical exam and even the customs at detroit (my POE) so i guess I most probably have to get a new medical exam i just pray my CS wont charge me so much.. because when I call them to give me an exact price they kept telling me they can't just yet..and made up an excuse about having the phone calls and his time part of why the fee was that much...

last time we went there, they said everything (vaccination record transcription) and the vaccines were all $160 but when we were already there they had my paperwork and everything they then said it was an additional for the 2 vaccines.. so we ended up paying about $260 for 2 vaccines and the medical transcription. So I don't trust him very much

Hello, I told you in my email that possible your RFE is I-693, same as what happened to other November filers without knowing the exact reason for it.

I also have the I-693 RFE but my responds was another transcription and not full medical but I am not sure if they will able to ask another I-693. I talked to the USCIS costumer representative and he told me that I do not need a complete medical.

Those who just sent the DS 3025 also received same RFE letter "Submit a properly completed ans signed Form I-693..."

Hope everything will be well to our documents.

yeah i have called USCIS about my medical exam and even the customs at detroit (my POE) so i guess I most probably have to get a new medical exam i just pray my CS wont charge me so much.. because when I call them to give me an exact price they kept telling me they can't just yet..and made up an excuse about having the phone calls and his time part of why the fee was that much...

last time we went there, they said everything (vaccination record transcription) and the vaccines were all $160 but when we were already there they had my paperwork and everything they then said it was an additional for the 2 vaccines.. so we ended up paying about $260 for 2 vaccines and the medical transcription. So I don't trust him very much

Hope everything will be fine to our papers, I just responded by another transcription with 2 vaccinations and not a new medical, because I thought they asked another I-693 because Dr. Arnold made my first I-693.

Well, I hope I will not receive another RFE for I-693 because the cost is not a joke.

yeah i know, but with mine they are asking for my medical exam so there's a great possibility they lost my result otherwise they would've just asked for the vaccination records..but it did state in my RFE that they want the medical exam and to be done by the civil surgeon and all that stuff

In your RFE does it says " Submit a properly completed and signed Form I-693, Report of Medical Examination and Vaccination Record (Rev. 06/05/08 or later) for the applicant on Form I-485. The medical examination must be conducted by a civil surgeon who has been designated by USCIS. The medical must be issued less than one year prior to the filling date of Form I-485"

yeah I know, so I don't understand right now what we need to do.. if I need to do a new medical or just the vaccination record.. i talked to the civil surgeon's assistant who deals with the immigration paperwork, he said that means they lost the whole medical exam.. i called USCIS.. the lady just kept saying.. read the letter and follow the instructions, it's all there.. so listening to that very very helpful information just made my day, it made me wanna blow my brains out knowing that the people from USCIS cannot even give us any answers.. but hey, nothing new right?..

this is really just so hard.. im afraid that if i only respond with the vaccination record, i might risk a denial.. and then face deportation.. that would just be way to much ..

so i don't know how to really handle this.. heeelllpppp
