Hello Everyone.

My fiance arrived on 11/28/09 and we got married on 12/6/2009 and I am currently gathering information for the my husband's AOS. I tried reading the guides but ended up getting confused, do they need my copies of my passport pages, birth certificate or just my husband's? What else do they need from me apart from the Affidavit of Support, tax transcripts, W2s and do I put my maiden name on the paperwork or my married name where necessary information about me is required? Thanks.

Hello Everyone.

The AOS is primarily all about the foreign spouse.

What else do they need from me apart from the Affidavit of Support, tax transcripts, W2s and

Are you sure you've gone step-by-step through the "Assembling the I-485 Package: Checklist" section?

do I put my maiden name on the paperwork or my married name where necessary information about me is required? Thanks.

If name changed - you can use new married name on the forms where applicable.

It can sometimes help to print out the above link (step-by-step assembly guide) and complete each # one by one and check off each as you go. :star:

Please do you know if my birth certificate should be included in the package also, i read somewhere that someone got an RFE for not including her USC's birth certificate and i have read the guides it says nothing about birth certificate. Thanks

If you have tax transcripts - you do not need the W-2's - they are included with the transcripts. (In fact - if you just send in the W-2's without the corsponding 1040's, you would most likely get a RFE)

Otto has answered the other questions - you do not need your USC BC for the AOS as he noted.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS
