I'm looking at the guides and it all seems pretty straight forward. However I have a question about the I-864. I have been a stay at home mom for way too many years so I have no income tax forms since like 2002 and hubby works here in Sweden as a store clerk. We'll be living with my parent (renting the basement from them). Can my parents fill out the I-864 and sponsor my husband? Between income and assets their income is like 60K for the last few years. He'll get a FT job and me a PT job once we get there but in the general labor field I find most people don't hire outside the US lol!

The parents can co-sponsor; many DCFers use a co-sponsor as they don;lt have US income and few have enough assets to qualify. Two things here:

- 60'000 may not be enough, depending on the household size, and how much of that money is regular, annual income and how much is assets (a co-sponsor must provide 5x the assets for income- so if the income is 10'000 short, then there would need to be 50'000 in assets).

- You still need to provide your own I-864; you can list any of your own assets there if you like, to add to your parents. As you have not filed taxes, you will need to provide a short cover letter explaining why (ie no income).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

*added* Hahaha apparently I forgot how to use my google lol. You have to be above the poverty minimum income and my parents exceed by 20K in income alone for 7 people (5 of us and 2 of them). I found it here if anyone else needs http://www.state.gov/documents/organization/86991.pdf

It is my understanding the household size considered would be your parents and anyone they claim as dependents, you and any of your children who are not to be on the affidavit of support should not be considered as dependents as you are not dependent just because you will be living in the house. You are a dependent of yourself. So like in my situation, my mom is the joint sponsor and has no dependents so all she needs is to make the amount shown for 2 people, herself and my husband. The point is, she can't claim me or my children as dependents on her taxes so she would have to prove support for us either.

If I am wrong someone please correct me if I am wrong.

It is my understanding the household size considered would be your parents and anyone they claim as dependents, you and any of your children who are not to be on the affidavit of support should not be considered as dependents as you are not dependent just because you will be living in the house. You are a dependent of yourself. So like in my situation, my mom is the joint sponsor and has no dependents so all she needs is to make the amount shown for 2 people, herself and my husband. The point is, she can't claim me or my children as dependents on her taxes so she would have to prove support for us either.

If I am wrong someone please correct me if I am wrong.

Well that does make sense!

This is what it says on the I-864 and this is speaking to the person filling it out, so when your dad fills his copy out this is how he will count the dependents:

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support. If necessary to meet the income requirements to be a sponsor, you may include additional relatives (adult children,parents, or siblings) as part of your household size as long as they have the same principle residence as you and promise to use their income and resources in support of the intending immigrant(s).

I hope this makes it a bit more straight forward for you.
