Hi everybody. I hope you can help me with my case.

I'm a J-1 italian student. My visa will expire in march 2010, and at that time I will come back to my country.

Few days ago I lost my passport, with my visa stamp and i-94 inside.

I'm going to apply for a new passport at the italian consulate.

My question is:

- do I have to apply for a new I-94 too?

Additional information:

- I have a photocopy of all pages of my lost passport, including visa stamp e I94 record.

- I don't have to reenter the USA with my actual VISA because it will expire the day I leave USA.

- I have the boarding pass which prove the day I entered the United States.

The reason of this question is, obviously, that I don't want to pay the 320$ fee for the I-102 form, to renew a I-94.

Timeline

If you are a foreign citizen temporarily in the United States, and you lose your U.S. visa, you can remain for the duration of your authorized stay, as shown on your Arrival-Departure Record (Form I-94). You will need a valid passport to depart the United States and to enter another country. Your I-94 is needed as you depart the U.S., to document that you are departing by the required date. If your passport with your I-94 are lost or stolen, you must get them replaced immediately.

Yes you need to get the I-94 replaced as it is necessary when you leave the country to submit it.

But, for example, if I leave the united states, going to mexico for few days withount giving my i94 to the officers, re-entering the united states i will receive a new i94 and nobody will coud care about my first lost i94.. right?

Timeline

If you left for Mexico for a short time and re-enter the US, the US will expect to see your previous I-94 (since it is not necessary to surrender your I-94 for a short trip, it will be expected that you are still in possession of it and when it is not there, you will be in trouble). You won't be issued a new I-94 but instead they will expect you to have your old one

Replace the I-94
