Need work permit now!!!

On June 28th I had my biometrics appointment in St. Louis. It is now July 24th. On average, how long does it take to receive it in the mail? I got a job at Federal Protection Inc and cannot start working until I have the permit. They are already starting to get impatient with me, sending me emails, letters and phone calls wanting to know the status. I keep telling them it's out of my control.

I JUST got off the phone with a USCIS rep. and she said the they received my EAD application on June 5th. She said that was all the information they had. How annoying is that?!?!?!??! How can I find out whether or not I will receive my work permit any time soon?

No way of knowing. You're not even able to apply for the interim EAD until after 90 days of USCIS receiving your application, which would put you in early September. All the best.

Having your biometrics taken is no indication of when you will receive the EAD. 70-80 days since receipt by the USCIS seems to be the average. I know it must be frustrating.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Talk to your employers about what it says on the I-9.

"If employees are authorized to work,but are unable to present the required document(s) within threebusiness days, they must present a receipt for the application of thedocument(s) within three business days and the actual document(s)within ninety (90) days."

So essentially if you have NOA1 for the I-765, you can start work and within 90 day of starting, need to give your employer the EAD. You should get the EAD within these 90 days if you already applied for EAD some time ago.

EDIT: Hmm, maybe not when I think about this. It says "If employees are authorized to work", which presumably you aren't until you get EAD. This is a bit of a grey area on 2nd thoughts.

I would say if you have not heard anything by Sept 4th (85th day) make an infopass appointment for Sept 11th (91st day) that is the earliest you can apply for an interim EAD.....

Untill then you just have to wait..... sorry

He is not authorized to work until he has the EAD in his hand.... the above extract is for people who are renewing their EAD at the end of the 1 year period.....

:blink: I just got of the phone with them too.I had my biometrics taken on june 1 and i'm still waiting.It is getting annoying as i need my driving license ...The lady told me i had to wait 4 to 6 weeks!Oh well!

25 March 2006 - Mailed AOS package to Chicago! (I-485, EAD, AP)

28 March 2006 - AOS package recieved (day 1)

4 April 2006 - I-130, I-765 (EAD) NOA date by USCIS. NO AP, yet. (day 7)

6 April 2006 - Checks cashed (NOT AP)

7 April 2006 - I-130, I-765 NOA's recieved in mail! (day 10)

10 April 2006 - I-131 (AP) RETURNED. Should have mailed it to Nebraska Service Center <confused> (originally sent it to Chicago Lockbox with AOS..) (day 13)

11 April 2006 - I-131 mailed to Nebraska as requested (day 14)

14 April 2006 - Bio appt letter in mail (day 17)

17 April 2006 - I-131 (AP) NOA1 received(day 20)

2 May 2006 - Biometrics completed I-485 and I-765 (day 35)

9 May 2006 - I-131 (AP) RFE email recieved, RFE request by USCIS. (day 42)

13 May 2006 - RFE Recieved, missed a bunch of stuff? (day 46)

15 May 2006 - Mailed requested info back (Nebraska) (day 48)

22 May 2006 - I-485 Interview Notice Arrived! (July 13th)! (day 55)

22 June 2006 - AP Approved (day 86)

29 June 2006 - Interim EAD success in Denver DO.

13 June 2006 - Interview. "not concrete approved", received two emails later same day approving I-485 and I-130. "welcome notice was mailed" and "approval notice was mailed"

17 July - I-485 Welcome notice received and I-130 approval received

18 July - I-485 "after approving your application, we ordered you a new card" email received.

24 July - GREEN CARD RECEIVED! All info correct. Apply to lift conditions 7/13/08

my EAD took about 6 months from when i applied for it. I didnt go for an interim but it does appear most people seem to have a 80 - 90 day turnaround.

Hope you dont have the bad luck i did.

Oh dont bother with the helpline they put 2 notes on their system to try to get it sped up (had to wait a month between each one) Infopass is the way.

oh and for the record i had my biometrics in mid feb and recieved my ead in june.

I was approved about a month after the biometrics was done. My EAD took 81 days to get approved, from filing the paperwork to getting the card in the mail

Once you set up the info pass appt, for the interim will you get the interim EAD on the spot if its past the 90 days once you go in

not always true! some factors may prohibit obtaining an interim EAD much less on the spot. 2 examples below:

1- some local offices do not issue on same day, they hear ur situation and will send you an appt to appear to obatin on (as we did)

2- in some local offices, they will not issue you an interim EAD if your application has already been approved regardless if you have not received your regular EAD.
