Hello All,

My husband came here on a K1 we have lifted conditions and he now has a 10 year GC.

Since shortly after he arrived, he has been cheating, internet, phone, txting....IDK if he has been physical with anyone. (does that matter? phone sex is still sex)

To make a long story short, he took a job in another state, started his cheating BS, (each time gets closer to a physical interlude) He refuses to give me his address he has not been home in almonst 2 months and i dont know when he will come home. Most recently he does not want me to call him #######?????

I was researching online and I discovered that I can get an annulment based on fraud if I do it in the next 6 months.

Has anyone done this? I dont care about the GC and all that #######, I just cant take this anymore, since he came here my life has WAY too much drama. And it is getting worse.

I have told him if he does not want to be married to divorce me, but he wont.

I would like to pursue the annulment route, I was just wondering if anyone else has done this.

I am NOT trying to get him deported, I just cant take this ####### anymore. Quite frankly I dont think he wants to be married anymore either, he just does not have the balls to do anything about it.

weather you do an annullment or divorce, he will have to answer. I believe with the annullment it would be like when i did disolusion ... you both will have to agree. You can try this route and if he fights it, just go divorce...depending on your state you just have him served and then he has so many days to reply on it. if he dont reply, get a lawyer, or show up to the court date, you will get what you ask for in the divorce...which in your case is probably just ending it. Maybe this will wake him up and show you are serious.

Sorry this has happened. You just need to be strong on this.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

It sounds like you were used for the GC. Start the process for the divorce, I don't think you can do a annulment, if I remember reading right about this, you have a very short time frame after marriage to do that. In most states I do beleive when you dont know the address of your soon to be ex, you can just run a add in the paper for like 2 weeks or something.

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

I have 6 months from the time of discovery of the fraud to file for annulment. I only just realised that was his ultimate plan. So I do think I qualify, I have read of others doing this succesfully, I was hoping someone on here would have more nfo about it.

From what I understand, an annulment is difficult to get and takes time. You'd need a lot of proof, and with the marriage having gone on for 2+ years (as you mention he has a 10 year greencard), I think it would be very difficult o get approved for an annulment. A divorce would be quicker and easier, especially if you cannot contact him to answer.

what i was told is you need to make every attempt possible to serve him. You need to document all this. He needs to keep his address updated with the USCIS. Talk to a lawyer. they were telling me that you can even hire an investigator to find him. He has to have some sort of phone/utilities that are under his name hopefully. You will just need to show the court that you made every attempt to find him.

Your question would get a better answer from a family law attorney. From what you say there is nothing to do with immigration.

Find a qualified attorney in your area and discuss the details of your situation with him/her.

This is similar to my friends story. Courtship ws one way. Once he arrived he was someone different.

To get the annulment you have to show proof of fraud is what i believe.

Sounds like he is playing games with you, at the expense of you and yoru family. MIght be easy to just divorce and move on.

6 months from discovery is good news to me. I am considering filling an anulment on that bases.

He has to report where he lives to the USCIS at all times. If he doesn't he could be deported on those grounds. hint hint. LOL

If you happen to know where he is employed, would it be possible to contact the employer and get his address that way? I know there is the privacy laws in place...etc so it might be hard to get the address out of anyone. I filed with Child Support Service Agency to get them to get the back-support owed to me....a week or so after I filed, my ex changed his address. I called to notify Child Support of his new address. When I called months later to inquire on the status of my case, they said that he had been served and I asked what address they sent the sheriff to & they told me that they couldn't give me the address due to privacy laws----I was the one that gave them the new address!!!!

Good luck...I pray you get relief soon. Oh & the divorce route is quick if you don't share any property...etc. I did my divorce myself and I was divorced within 1 month of filing. I do live in NC & I don't know how much different the laws are where you are. In NC you must be separated for 1 year & 1 day before you can file for divorce...but you don't have to provide documentation on separation date here. I can send you the "template" documents I used and tell you more about it if you need any help. Just PM me!

What you described is your husband being unfaithful and abandoning your home. How do you know that fraud was his ultimate goal?

If you know where he works, he can be served at work...

You can't do an annulment,you have to file for divorce.So what if he doesn't want to,if you want to get a divorce,he can't force you to be with him!

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE

His ultimate goal not to come home....not GC fraud, I am not saying visa fraud, I am saying a fraudulent person, as in cant be faithful to a marriage.

I plainly said I did not care about the GC. This is not about that.

I really am not going to give details here, but I have all the proof I need.

Thanks for the advice everyone, I am going to take my chances.....

He is suppose to register his address with the government every time he moves. If he fails to do this he is in violation of his visa. You should be able to contact USCIS and find out where he is or let them know he has disappeared.
