I have my consular interview for K1 in early January and I am extremely concerned that the result of the medical will mean refusal.

Several years ago my ex husband was unfaithful to me and gave me STDs. One was cleared by antibiotics but the second was HPV (genital warts) and it cannot be cured. It recurrs during illness or stress and is likely to be visible during the examination. I am deeply ashamed of this, luckily my husband to be accepts it. I am frightened that after all of this waiting I will be refused immigration since this is 1)an STD and 2)contagious.

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) has, since Nov. 13, 2009, temporarily held certain applications to adjust status to lawful permanent residence until new CDC vaccination criteria become effective on Dec. 14, 2009.

The Department of Health and Human Services (HHS), Centers for Disease Control and Prevention (CDC) announced on Nov. 13, 2009 new criteria for determining which vaccinations will be required for applicants seeking to become lawful permanent residents. Based on these new criteria, and beginning on Dec. 14, 2009, the vaccines for herpes zoster (zoster) and human papillomavirus (HPV) will no longer be required for immigration purposes.

As a result, since Nov. 13, 2009, USCIS has held any application that would have been denied solely based on the applicant’s failure to show proof of having received the HPV or zoster vaccine. USCIS will resume adjudicating these applications on Dec. 14, 2009, using the new vaccination criteria, which eliminate the need for the HPV and zoster vaccines.

The vaccination is a preventative measure (and for only one strain of the virus, there are many strains) and does not cure you once you have contracted it. I will however look at the link and see if I can discern anything regarding actual infection. Thanks

Hi, I did some search online and I couldn't find anything about "if I have HPV". Anyway, I found information about syphilis and tuberculosis and I know that's not the case, but as I can see, there is a way to immigrate even if you have these two. So what I recommend is for you to call the doctor that you are going to do your medical and ask him what you should do in advance.

civil surgeon's form

Check out the actual form the civil surgeon fills out. Page 2 is about communicable diseases. None of the questions have anything to do with HPV. I'm doubting it's going to be an issue for you.

In general, a 'health related' condition renders one inadmissible for if one has a communicable disease that the the dept of H&HS terms as one of "public health significance". I'm not sure if HPV is such a disease...but I think it is part of the screening during the medical.

Section 212(a) of the Immigration and Nationality Act reads:

(a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:

(1) Health-related grounds.-

(A) In general.-Any alien-

(i) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to have a communicable disease of public health significance, which shall include infection with the etiologic agent for acquired immune deficiency syndrome,

About 70% of women in the US will contract HPV sometime in their life. Most of them will not even notice since the condition clears up before it manifests itself during an abnormal pap smear. Like you said, a healthy body usually keeps the virus in check unless you are stressed out or otherwise sick like with flu etc.

I very much doubt you will have any issues with this.

Are they doing Pap smears during the medical exam in your country?

Make sure you have regular Pap tests done once you're here!

My best friend is a doctor and he has just informed me that HPV is classed as an Sexually transmitted infecttion and not a sexually transmitted disease and as long as you are receiving treatment for it then it will not be an issue for your visa. Now whether it will become an issue for your AOS is another thing that he can't comment on because he knows very little about what a US Civil Surgeon will be looking for. But I really wouldn't worry too much about it for your K1 visa. Apparently 50% of people with HPV never even know they have it.

...what a US Civil Surgeon will be looking for.
If your K-1 medical examination is still valid (within a year), you will not have to undergo examination by a Civil Surgeon. His only role vis-a-vis AOS would be to transcribe your vaccination records onto the I-693 form.

Before you leave your country, get at least TWO certified (notarized, official, on medical letterhead, or similar format) copies of a record of every vaccination that you've ever had, along with dates & places. Make sure that you have a copy of this for the I-693 part of the AOS process. For people who received the BCG as an infant, this should be noted on the vaccination record, because the BCG can produce false-positive results for tuberculosis.

It's also a good idea to get the standard, required boosters (tetanus, MMR, and chickenpox/varicella if applicable) in your country, because it's almost always cheaper & easier than doing so in the U.S. (and usually under time-pressure to file for AOS).

Also (a bit off-topic), be sure to get a fresh driver's license from your country, and an International Driving Permit. You'll be glad that you did, once you're here.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
