Hello again. My daughter had her interview today at the US Embassy in the Philippines, after failing her medical test in August. Everything went well today except for one item, the AFFIDAVIT OF SUPPORT. When I applied for the I-864, it was stated that it covered the whole family. And the US EMBASSY and the Counselor knew this, but apparent since the original copy is stored in the archives, they can no longer pull the documents out. And my daughter was told that a NEW I-864 is needed. My wife and I checked the form and this was stated]Often a spouse or minor children obtain visas or adjust statusas dependents of a relative, based on the same visa petition. Ifyou are sponsoring such dependents, you only need to providea photocopy of the original Form I-864, as long as thesedependents are immigrating at the same time as the principalimmigrant or within six months of the time he or sheimmigrates to the United States. You do not need to providecopies of the supporting documents for each of thephotocopied Forms I-864[/font]..What step should we take, please help!! I suggest a brand new I-864 packet - perhaps consisting of a copy of the original one, then the supporting documents.

Seriously, I thought since is two I-130 petitions, must have totally seperate NVC document set also.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Thanks... but where should we apply? Our case is already done at NVC, NVC no longer have our case. Does this mean we have to start all over again?

hi! I suppose you will re-submit your I-864 to the embassy. Our I-864 didn't went through NVC (actually the NVC didnt process our papers at all, our military expedite requested was granted so they forwaRd it directly to USEM), we will be submitting our I-864 to the USEM tomorrow.

my two kids will be having their interview later. 7am. i wonder if they'd ask CENOMAR from me. their biological father's name didnt appear on their BC's and I was never married to him. Pls help...thanks

Dean - if there was any problem, if the child needed more documents, a piece of paper would have been issued, detailing 'what' .

Review that piece of paper, if it's asking for updated I-864, then give it to the embassy, using the procedures outlined in that piece of paper.

is USEM holding her visa prior to submission of your i864? if you have a photocopy then submit that asap or better, fill out a new one but make sure you put the same info from the original, of if you don't have a photocopy, just fill out a new one...this is an easy matter so you should be ok.

First...

When applying for IR/CR 1 & 2 you need to provide 2 Affidavit of Support Packets even though you only pay one $70 Fee at NVC Stage.

The packets are identical except where you list who the beneficiary is (Section 2). In Section 3 you only select that you are sponsoring the Primary Beneficiary. If you are including a Employment Letter the IR/CR-2 can use a photocopy of the original you included with the IR/CR-1.

This sounds contrary to the I-864 instructions but it is how the NVC instructed me to file the AOS Packets and my wife & stepson are now here so I can say it worked.

Remember the IR/CR-2 IS NOT DERIVATIVE of the IR/CR-1 like the F2 is of the F1 Visa, they are considered separate petitions/applications and therefore require their own set of supporting documents.

If the USEM issued a white slip then you need to submit the AOS directly to the USEM.

Your question doesn't relate to the OP's issue and would get better attention either in a new thread or one of the existing threads dealing with children from previous relationships.

My wife was told they needed to see her CEMAR to confirm that she wasn't married to her son's biological father. Luckily we had already ordered the document and she produced it on the spot narrowly avoiding the white slip and converting directly to a PINK slip!

FWIW, Gabby's bio-father did sign the back side of his birth certificate.

Thanks everyone for all the info... We got our answer from the US Embassy Call Center in the Philippines last night. It took awhile to get all the info regarding about the AFFIDAVIT OF SUPPORT. Since the original form is in the ARCHIVES and can no longer be pulled out, all is needed is a new form with a signature...I had the form signed and shipped via FEDEX this morning to the Philippines. It will be in the Philippines this Wednesday, God willing our daughter should be with us before xmas.

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg
