hi all,

today is very sad day. i went for my interview at the embassy and they give me back my passport and a letter saying 'unable to issue a visa to you because you have been found ineligible to receive a visa under the ff section:

section 221 (g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act issued pursuant thereto. There following remarks apply in your case:*

221(g) for police report and AOS. Requiring proof from IRS of 2008 taxes. (Quarterly tax filings)

Please help me. Does this mean i am no longer able to get visa issued anymore?

However, The lady that interviewed me asked me to get police clearance of my fiance and also his quarterly tax filings.

Is it already denied?? or i can still get approved??

Hi! I knew what's your feeling right now because I've been in your situation. It took time for me to calmed down and I was crying before. I thought that I was denied. I was in AP/ AR for 3 months but thanks God I am here now with my husband.

It was not a denial. You need to get the requirements of what they asked for you and you'll be alright. Sometimes, it takes time for them to review your case but just hang in there.

tell your sponsor too that try looking for CO-sponsor to help you out, like a relative with w2 income, it will help a lot

we'll probably need co sponsor. his friend agreed to be co sponsor. i just wonder what sort of doc co sponsor should provide. should bank statement be fine? or has to send income tax too?

You're kidding right? Anyone who can read the instructions would know that they need to obtain Police Clearance for all countries where they lived/worked for 6 months or longer.

Uhm, i just read the instructions here and on the goverment site, and i dont see that they request you to have police clerance where both the petitioner and the benificiary need to provide for all countries lived or worked for 6 months or longer, that means that I need police clearence from China where I was born and then for Sweden where i've lived since the age of four, and my fiance need to get it from USA, Germany (where he was stationed in the Iraqi war 2003), Brussel, Ecuador.. if this is all true then i would like someone to post a site or something because i read the instructions and all like 100 times and I have never come acrossed that you need a police clearence for both!

They don't ask for the petitioners police checks at all. They do ask for Police Checks from any place you have lived/worked longer than 6 months since the age of 16, and at least on our paperwork from the consulate that was very clearly written.

I'm also on 221g, but I noticed that we don't have the same statement written on our white slip:

hers:

So, girl, what did you have? Is it written anywhere on your white slip that you just have to submit additional docs? coz if it is, it's not a denial, you just have to comply and you'll have your visa sooner than you expect.

yes, sadly you were denied, that's why your passport was returned w/a note from usem stating the reason for denial.

abbynorm1 your situation was different, you were in AP, which means you're eligible to get a visa and only lacked a requirement which you eventually produced and submitted.

ninjones, you're situation is different too, you're eligible to be issued a visa but after you submit the docs you're being asked to submit.

lostgirl sophia, smudgy's application was denied, as stated in the letter she received...and that's why her passport was returned

smudgy, i don't mean to make you even more sad, but please do not be confused by all this misunderstanding, -that you are not yet denied and only need to submit documents.

what you need to do is plan for an appeal. if the reason cited for your denial is not true, file for an appeal.

thsi is what denial based on 221g means:

(g) No visa or other documentation shall be issued to an alien if (1) it appears to the consular officer, from statements in the application, or in the papers submitted therewith, that such alien is ineligible to receive a visa or such other documentation under section 212, or any other provision of law, (2) the application fails to comply with the provisions of this Act, or the regulations issued thereunder, or (3) the consular officer knows or has reason to believe that such alien is ineligible to receive a visa or such other documentation under section 212, or any other provision of law: Provided, That a visa or other documentation may be issued to an alien who is within the purview of section 212(a)(4) , if such alien is otherwise entitled to receive a visa or other documentation, upon receipt of notice by the consular officer from the Attorney General of the giving of a bond or undertaking providing indemnity as in the case of aliens admitted under section 213: Provided further, That a visa may be issued to an alien defined in section 101(a)(15) (B) or (F) , if such alien is otherwise entitled to receive a visa, upon receipt of a notice by the consular officer from the Attorney General of the giving of a bond with sufficient surety in such sum and containing such conditions as the consular officer shall prescribe, to insure that at the expiration of the time for which such alien has been admitted by the Attorney General, as provided in section 214(a) , or upon failure to maintain the status under which he was admitted, or to maintain any status subsequently acquired under section 248 of the Act, such alien will depart from the United States.

how exactly were you instructed? ex. "get the documents and come back asap" because if that was the case you should not have been given that note that officially says you're not eligible to be issued a visa...

but if you will read the latter part, there are exemptions, so like i said if the reason for the denial is not true (ex. they said you did not submit the correct documents but in truth you did) then fight for your right to a visa

HOw about me? I was put in AR dec 17, 2009. But they didn't indicate any docs to be submitted and they didnt tell me why i was put in AR? but didnt give me back my passport? SO what was that? denied as well?

it means your case is still being looked into closely...you don't necessarily lack any docs, they're looking into your application requirement by requirement and as a whole...you're not denied nor approved yet, they don't have a final decision yet because they're not done assessing your application, you just need to wait

hi everyone.

just want to update you guys about my case.

i went back to the embassy on the 14th of Jan and gave them tax returns and my NBI. They received it and took my passport and told me that my visa wll be tentatively ready by the 22nd of Jan. If they contact me before the 22nd, that means that my visa wont be ready yet.

im so happy.

thank you all guys!!
