Yo, you've NOT been denied. You've been placed in AP/AR and once you give them what they are asking for, your visa will be issues.

You will need your police clearance from PI.

And your fiancee's tax returns.

Do it ASAP.

Good luck!

hi all,

today is very sad day. i went for my interview at the embassy and they give me back my passport and a letter saying 'unable to issue a visa to you because you have been found ineligible to receive a visa under the ff section:

section 221 (g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act issued pursuant thereto. There following remarks apply in your case:*

221(g) for police report and AOS. Requiring proof from IRS of 2008 taxes. (Quarterly tax filings)

Please help me. Does this mean i am no longer able to get visa issued anymore?

However, The lady that interviewed me asked me to get police clearance of my fiance and also his quarterly tax filings.

Is it already denied?? or i can still get approved??

please help..

Thanks a lot

If you got the 221g that don't really mean you are denied. They are asking from you more documents which you failed to submit with your application. I had 221 g after my k1 interview but i got my visa after a month(that worried me too).

:wacko::crying:

They did not asked more documents from me but instead they told me to wait till i hear from them..Also they did not give me my passport .I guess they were just double checking my documents since i have 2 kids and was not married to the kid's father.

Give them the documents they want from you.

Pray sis.. prayers really works..I just had a miracle.Good luck and keep us updated.

Seriously OP's reason for 221g is not her fault.

She is the beneficiary

That statement is insulting to all beneficiaries as it implies that they can't understand the process & requirements. My wife was also the beneficiary and she noticed things that I missed!

and who would really know that you would need police clearance from both countries. She is residing in Singapore,

You're kidding right? Anyone who can read the instructions would know that they need to obtain Police Clearance for all countries where they lived/worked for 6 months or longer.

and how would she be familiar that she needs quarterly tax returns. This is a request for additional documents that most of beneficiaries would not be familiar with.

I'm wondering why you're defending the Op when there has been no attack?

Your average petitioner wouldn't need to file Quarterly Tax Returns but someone who is self-employed in the US should be used to having to provide additional documentation for their on-going income.

Besides it's just a small bump in the road, they'll get the needed documents and be fine...

Are u sure its not your police clearance they are asking for? It would be strange for them to ask for police clearance of the petitioner at the embassy stage. I could understand if they are requesting his quartery tax filing becuase he is the USC and sponsering you. Did you submit your police clearance?

Also, it seems like 221g's are very common and usually if you submit what is required you normally will get your visa approved. Do not fret about this and just get them what they need asap.

Star

I know what you are talking about.I was denied in June for the i129f,fiance visa.i had all the proofs, two manila envelopes with proofs, western union slips as thick as a book, bank statement and other proofs. The consulate told me that we were filing for the wrong visa and that my fiance should come and marry me and then file.i met my fiance in 2006,we got engaged and he filed last year November.I think I was denied wrongfully, the said i was denied under that same 221g.the consulate didn't even look at any of my proof that i had.he just asked me some questions about how my mom and sister got to America.i don't see why that had anything to do with my fiance filing for me.he almost lived here with me,its just that he had to leave for medical reasons.now he is here and we are getting married in 2010 and he dont plan to leave until I can go with him.

Uhm, i just read the instructions here and on the goverment site, and i dont see that they request you to have police clerance where both the petitioner and the benificiary need to provide for all countries lived or worked for 6 months or longer, that means that I need police clearence from China where I was born and then for Sweden where i've lived since the age of four, and my fiance need to get it from USA, Germany (where he was stationed in the Iraqi war 2003), Brussel, Ecuador.. if this is all true then i would like someone to post a site or something because i read the instructions and all like 100 times and I have never come acrossed that you need a police clearence for both!

thank you star for your reply. i really appreciate it.

they are asking me for police clearance from philippines as i come from there but i am living now in singapore. i only gave them police clearance issued by singapore police.

my fiance gave his income tax but officer requested for quarterly tax filings. office said that she's afraid my fiance wont be able to support me.

do you think additional bank statements will help too?

thank you

The additioal bank statements are a good idea. Get everything that shows he has sufficient income. But, they usually want what they request as far at the quarterly filings. The bank statements could be proof of additional income.

tell your sponsor too that try looking for CO-sponsor to help you out, like a relative with w2 income, it will help a lot
