I-130 concurrently with I-485

Guys,

I'm married to a US citizen. We filed for I-130, I-485, I-765 and I-131. I forgot to attach photos to I-765 and I-131. What is going to happen? We just sent it 2days ago so we haven't got any ref NO yet. I'm thinking of sending a letter explaining and attaching photos to it also. As marriage bonafide is concerned I sent a copy of her pregnancy positive result, copy of our engagement rings sale ($4500) and a copy of our car insurance with both our names on it. Is it enough evidence? Any comment is appreciated.

Pregnancy is not a marriage bonafide, anyone can have a child with anyone! I think you should have included a lot more evidence than this with your packet.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Wait for the RFE so your photos (and anything else) can get married to your file.

A ring receipt doesn't show much about a bona fide marriage. A comingling of assets and life is what will help to demonstrate a bona fide relationship.

A pregnancy test result does not help to prove a bona fide relationship.

Do some reading in the VJ Guides to familiarize yourselves with the process.

Best of luck.

also,

there are a few forms that you haven't mentioned. Did you send the I864, the affidavit of support with the packet? if not then you'll get an RFE. And you don't mention the medical and vacciation i693 for. Did you have the medical exam and vaccination? and two passport photos.

for the bonafide marriage, photos of your relationship, anything together, such as a joint bank accout, bills in both names, lease, car insurance, anything in both names.

The I-130 instructions contain a list of 'types of evidence' for proving up a bonafide marriage. Have a read? What did you include, from the list of types?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I did inclue I-864 with 2 photos for I-485 and 1 for I-130. Car insurance card showing both our names on it. The ring receipt includes both our names on it. Also the pregnancy test is from the clinic of my school with her name and our address on it. I think these evidences are strong enough to back marriage bonafide.

I haven't done medical and all bills have my name on it and we don't have a joint bank account since she does not work and I'm paying all the bills.

Probably good to go ahead and do the medical already, since you'll likely get an RFE for it.

As to the joint bank account, it won't hurt you to get one and it's usually free (and even if you're paying all the bills, I think it's a good idea).
