So I'm trying to get this affadavit of support ready to go and I'm really confused by question 8. I've researched it extensively and I get different answers.

I am divorced and I have a 7 year-old daughter. I pay child support. Some folks say that I only need to answer this question if I claim someone as a dependant on my taxes. Others say that even though I do not claim her on my taxes, since I pay child support I should indicate that she's "partially" dependant.

I have no idea how to answer. Both answers make sense. It's hard to believe I can't just call someone and ask them to clarify.

Here's what I've got so far:

1. The I-134 filed out, (aside from question 8) signed and dated.

2. Letter from employer stating my position and that it's permanent, start date, and salary on the organization's letterhead.

3. The 3 most recent earnings statements/pay stubs. Since I'm not self employed and my last tax return does not reflect my current amount of income, I see no reason to include any tax forms.

Does this sound about right? I have no desire to get an RFE.

Any help is greatly appreciated.

can't help with your question but I have another twist on it the maybe people can help with at the same time - if there are no tax returns due to insufficient earnings or the children are not declared on the tax returns AND there is no official child support paid (there is a voluntary arrangement between my fiance and his ex, nothing through the courts) how does this affect the number/status of dependants on the I-134/I864?

May 2007 Met online

6th November 2007 Met in Person, returned to UK 9th January 2008

23rd June 2008 2nd trip to USA, returned 26th August 2008

22nd June 2009 3rd trip to USA, returned 20th September 2009

10th November 2009 I-129F package sent

17th November 2009 package signed for

12th December 2009 RFE(???) for CERTIFIED Divorce certificate, still not got NOA1

14 December 2009 TOLD OUR PACKAGE IS BEING RETURNED FOR INCOMPLETE DOCUMENTS - THERE GOES OUR TIMELINE BY 2 MONTHS

27th January 2010 STILL waiting for an NAO1!!!!! Packet was sent to someone else with same name and never returned, weather caused delays, telephone helpline ppl just keep saying to phone back as we have to be reassigned a new number. Argh!!! We should be approved or denied by now!!!!!

what about if there is no official child support paid? my fiance only paid as and when he could work but now the mother of his kids is refusing him access (and has turned his kids against him to boot). I guess that they WILL still be included in the household size but it's a 'slap if the face' to my fiance under the circumstances.
