It sure does! I think maybe you're right - the list isn't that reliable. Maybe it doesn't get reliably updated?

I know nothing at all about waivers! and I wish you the best of luck, I hope everything goes smoothly and speeds up for you.

As for the VWP, My father-in-law has a 30 year old CIMT, I thought he was unable to use the VWP? I see that your husband used the VWP with this CIMT. While traveling on the VWP, did he tick yes to the question? and has he tried using the VWP since ESTA came into affect.

My husband is heartbroken that his father can't come visit us. I don't understand how any of this works, and my father-in-law has no intention at all of moving or living here in the US.

Some CIMT are forgiven after a certain time spent, also it depends on what the crime was..

Best bet is to get appointment with London and they can tell him ....If he can't use a VWP maybe he can apply for a B2 visa.

Yeah, he did check yes in the box. When he came here, he bought his ticket from a travel agent. Nobody even mentioned the VWP (he had never flown, other than a little commuter within the UK). Somewhere over New England, the flight attendant started passing out the landing cards. He read the question about crimes and thought it was asking if he'd been convicted of a crime that resulted in a 5-year sentence. (he hadn't.) We thought our only responsibility was to make sure he left within 90 days, and we were so crazy about making sure he did. He hasn't been back since we found out that he wasn't eligible for travel under the VWP in the first place, but the damage is already done for us. (You should have seen the drama when we found out that this would mess up our future :crying: )

We made a terrible mistake using the VWP. And we have said so honestly in our waiver documents. We've emptied all our closets of their skeletons, and our fate now rests with someone who will read our stuff and decide whether or not they believe us. What more can you offer but the truth?

Don't use the VWP - it will land you a misrep charge, which is a permanent ban from the US. I'm not sure about the B2. Hopefully, someone will advise you about that.

I did just do a bit of Googling, and there looks to be a non-immigrant waiver???

Thank you very much. Not sure what we'll do yet, maybe just meet somewhere until we can move back to England. Last visit to England cost us a fortune.

I thought the US didn't recognize the forgiven rule? maybe I'm wrong. I don't remember what it's called, but I thought the US seen all crimes no matter what.

Nope..Depends how long and what crime it was..

If it was something petty and only one time then 30 yrs ago, he have a good chance, but something like drugs ..rape..murder ect....well diferent story..

Kind of strange with the Uk Immigration crime visa laws.....they let Mike Tyson in the uk with his track record, and yep he was a pro boxer and all, but he never had a pot to piss in neither at the time they let him in....the Us is very much Different.....Money talks here, as u know.

My parents really don't have the money to visit England if we were to move but are free to visit as they have clean records, as for his parents, they have the money and would love to visit but are unable to do so. So we're unsure how it's going to play out. but we're both very young and have time on our side and will probably end up in England is the future.

Your Father-In-Law can file for a tourist visa to the US and (depending on the CMIT) likely find joy.

well if maybe in the future you both decide to move to England, it might be best for your husband to apply for a usc, then he be

Dual Citizen.....This will help you both when you travel back and forth over the yrs..

He can apply for US Citizenship after 3 yrs of being a P/R, take a look at his P.R card and make 3 yrs from that date....also he can apply 90 days before that 3 yrs of being married to a usc.

so 2 yrs 9 mths...

Good points.....No more Uscis, file fees, ect.

Bad point...he for the rest of his life would have to file with IRS, even if he lives outside the us.

But if his income is less than $91k a yr he won't be double taxed on his worldwide income, as the UK/USA has a tax treaty.

Not sure if anybody knows this but even if your a LPR and move to another country, you still got to file IRS taxes upto 8 yrs also..

Thank you very much Nigel! As that's all new to me. My husband won't want to hear that as this is his first year dealing with the IRS and he wasn't too happy about it. The reason we're still in the US at the minute is so my husband can become a dual citizen. We've decided to stick around until we're done with US immigration and then deal with the UK side, which is going to change next year I heard.

Thanks everyone for all the help! Not sure what we're doing next, I believe my father-in-law doesn't want to move forward until he retires next year. He's too busy and stressed right now to deal with the B-2.

The reason we're still in the US at the minute is so my husband can become a dual citizen. We've decided to stick around until we're done with US immigration and then deal with the UK side, which is going to change next year I heard.

Yep my advice is in your guys situation is apply for dual Citi....after 2 yrs 9 mths of being a LPR...it takes anything from 3/6 mths to become a usc...a walk in the park really after the other visa applications huh?

Yep it be a pain in the backside to file with the IRS every year, which he can do online now...so if he's mega rich then maybe stay away from the dual stuff....unless he's got a top accountant, who can deal with maga rich folks....Not me though.. :crying:

But if not then once a year for a hr to File his IRS taxes should'nt be a problem online.....you say right huh :wacko: ? :blink: and yep ive seen the Forms.. :whistle:

Yep the us is one of few who uncle scam sorry sam :whistle: follows around the world with his citizens...

Welcome to America and pay your Taxes nomatter where you live.... :whistle:

For your Future infomation Ive started a post on the Uk Citizen Test.

Have you & Hubby a go at the practice test.. I wonder if he passes the test LOl..

So for him doing the us test to become a usc will be a easy...

Harder for you i guess if/when that time comes around..
