Have you looked on immigrate2us.net to see if there is any anecdotal pattern to this?

I did, and I found one other Irish waiver that was sent back to Dublin after it had been completed. Apparently, it is Dublin who will send out the approval/denial letter. My Congressman's office has contacted the Dublin Embassy, so I guess now we just wait and see. It must mean that the case has been completed, despite the fact that the list doesn't show it. I can't think they'd send it back to Dublin for any other reason, can you?

Well, I know you said you were trying not to get excited, but my initial reaction is they send the case back for the visa to be printed.

Having said that, I have no idea who issues the letter.

I don't think you would just have to look for cases gone back to Dublin in particular. The policy of "who" issues the decision letter should apply across the board.

The only reference I could find was a waiver that was denied. It showed up as completed on the list, so the woman contacted London, who said she had to contact the Embassy. When she contacted the Embassy, they told her it was denied. So I know I can't get too excited.

Figures this would happen on a Friday, eh? So I have to suffer through the entire weekend.

Well, it's about a quarter past 4 in Dublin. I've always heard how easy it is to contact that consulate and get information from them.

Wonder what would happen if you picked up the phone and called Dublin?

Thanks, guys. I have no idea what it means, and I'm really trying hard not to read into it. I wish I had my letter from USCIS London with me. Does anybody out there have theirs? I think it says this:

IF the 601 is approved, we will notify the Immigrant Visa Unit at the American Embassy Consulate that your spouse had applied for the immigrant visa to let them know that the immigrant visa can be issued. If the 601 is denied; we will advise your spouse directly of the same and advise him of the procedures for appeals.

Can't say for sure, though. But since my husband has not been contacted by London, and my congressman says it's in "the visit unit" at Dublin, I at least have hope. :wacko:

I'm sorry that I didn't see this until after 5, your best recourse for today would have been to contact either DOS or the consulate directly. The DOS inquiry line can usually tell you if an approval has been logged or not (and they enjoy doing so.) As a rule, they will not relate a denial.

As for the 601 (I saw that you were wondering the standard of evidence in your case.) Even though the charge/conviction was over 15 years old, you still had to establish "Extreme Hardship." Really, the best indicator right now of success is whether or not you felt really confident in your waiver package.

Thanks! To be honest, I'm scared to death. I probably wouldn't have made the call anyway. I don't think I could handle it. Today, after my congressman's office called, I was so shook up that I couldn't breathe, couldn't even remember my husband's phone number! They were really worried about me at work, and people came running. It felt like I had left my own body there for a while - floated somewhere outside myself. I'm not sure how I'm going to pick up the phone when my Congressman's office calls again next week with news.

As for the strength of our waiver? I dunno. I told the truth, and it'll have to be good enough. If not? Well, I'll just have to deal with what comes. I cannot-WILL not-leave my 72-yr old mother vulnerable. She is entering a time in her life when she should feel secure, and without me, she won't. She cared for me, and she guided my dad through his Alzheimer's (at home!), and I will not slam her into a cold facility to be "cared" for by strangers. The poor woman has suffered the same immigration anxiety that I have over the past several years. I feel terrible about that, as I'm the one who married a foreign man, not her. But my security and hers are tangled up together in this big mess. One big Irishman in our lives and we'd all feel much better about our future, as he wants to help me care for her - loves her as she loves him.

I suppose everybody thinks their hardships are strong, because they're THEIR hardships. But my parents raised me to look a mile down the road & see that others are worse off, so I guess it's left me asking why I think I'm so special that I'll be granted an approval. I've been here & at I2US.net for a while now, and I've read a lot of immigration stories. When you see others' stories, and people have had to leave parents with cancer, or uproot their American citizen children to move to a third country, it engrains you with a sense of panic that doesn't go away. If *they* were denied, anybody can be. I pretty much walk around in a perpetual state of anxiety - have, in fact, for over a year.

While it's only been a year since we filed our I-130, it's actually been much, much longer since we started this whole process. We had a terrible time finding an attorney who would get moving on things. They're all about taking your retainer, but as soon as they get it, the line of communication seems to go dead. It took 6 months from our initial consultation until the papers were on their merry little way, and then we met various delays along the way. I ended up having to micromanage everything, and push and push and push! There were several problems with paperwork, etc., so I'm not even sure the fact that we used an attorney will help, as I don't have a whole lot of confidence in him.

All I can do is pray.

Taking care of your mother sounds strong, as long as you sent in complete documentation and as long as you had other hardships to go with it. Since you've been around I2US, you probably have a pretty good idea of how strong your package is, remember that some of those horror stories were not eligible for waivers or had much worse ineligibilities than your case and/or may not have had as strong a waiver as they could have.
