Hi all,

I am putting together my I-751 application on this rainy Saturday. Currently I am writing the index and the cover letter. I would like to get some opinions on what I have gathered so far.

Please keep in mind that I will be going to file under the divorce waiver. Is it a sufficient package?

11/08/2007 Immunizations check

11/12/2007 Medical

11/16/2007 Faxed the "checklist" back to the consulate

11/26/2007 Confirmation via e-mail that the consulate received the "checklist" and medical result

12/18/2007 I-130 petition approved!!!

12/20/2007 Notice of Approval arrives via snail mail

02/01/2008 Visa interview - APPROVAL!

02/05/2008 Received visa via snail mail. DCF DONE!

02/23/2008 Arrived in the U.S.! Flight to Seattle via Newark as POE

03/10/2008 Welcome Letter (Form I-797C, Notice of Action) arrived

03/15/2008 Another Welcome Letter (Form I-797C) arrived... what a waste...

10/07/2009 Divorce was finalized

12/17/2009 Filed I-751 to remove conditions on residence under waiver

12/25/2009 Refiled I-751 because USPS returned the filed to me (hmpf!!!)

12/31/2009 Vermont Service Center received I-751

01/27/2010 Received the Biometrics Appointment Letter. Never received my NOA1.

02/01/2010 Biometrics Appointment in New Orleans, LA.

04/24/2010 Approval of Removal of Conditions! No RFE or interview. Yes!!!

Sorry to hear about your marriage, but it also seems like your spouse is not being too difficult about your status in the states.

You seem to have covered your basis, providing evidence when you were married, then providing evidence for your separation.

There are other posts on this forum about other who applied with a waiver. Take a moment and go over some of those posts.. you might get a hint or two.

write your own affidavit and explain how your met your spouse, why you married him and the circumstances surrounding your split up / divorce. (read carrefully the instructions of I-751).

For good moral character, go to the police and get a statement that you don't have any criminal record (explain that is for immigration and they will know what to give you).

IRS documents are important.

(I didn't filed jointly - and I got approved w/waiver - so, basicaly they want to see how much you make/contribute to the US economy).

Thanks for your replys. I included the joint tax return in the list above.

The idea with the criminal record might help. I could to that also.

What about a letter of employment?! I mean it does not really have to do with my status here, but should I submit one as well?

And should I really write an affidavit also? That seems kind of weird. What weight does my affidavit has? They could assume that I would say whatever it takes of course, so does it really makes sense?

If they want to see if you are still employed and pay social security, they have means to do this... but if you pake a copy of a recent pay stub doesn't hurt and could also be used as proof of address.

(If you are able to keep a job for a long time, that alone says something about you. ... you know what I mean?! (works in your favour as a reliable, trustfull person - good moral caracter).

It is the heaviest of all. If you are called for an interview because your story and the supportive evidence that you submitted has too many missing pieces, then you better not contradict yoursef in your statements.

Your words count a lot, it's the truth..... until prooven otherwise.

Innocent until prooven guilty (of fraud - isn't this the whole purpose of this conditional status????)
