Lets gather all here those who will file DCF next year of January 2010..May we know what are those requirements you are still accomplishing, lets help each other! :)

HEY Mrs Faith we wanted to apply this December but it looks like we will have all in order in January so we're in !

Hi Tommy and Riza! Yes same here ..that was our plan before but running out of time for some of the rqmts to accomplish so we have decided more better to file by next year January 2010! What are those rqmts you are still accomplishing? Mine have to go to dfa and have our MC and BC red ribboned. How about yours?

Hey Mrs. Faith we also have planned to get that in 2010 but i have something to ask about the Red Ribbon MC or BC in DFA. So what are some requirements for that when U want to get one? Bcoz i have a friend Pinay and she was already in USA just last july this year and she got through process the CR1 visa type.. She advised me to get MC which has red ribbon but the BC is only authenticated from NSO. So lil doubt as of now. And since our MC with my husband will release this Jan. 2010, i married here in Pi and plan also for that. :)

MY INTERVIEW DATE IS JULY 8,2010 at 8:30AM but WE NEED TO RESCHEDULE FOR AUGUST!

Not that your not welcome here... But might I suggest that those filing DCF start a thread in the DCF forum??/ That way if you have any questions you can get the input of others filing DCF as most of us here in the regular CR/IR section are not familiar with the requirements of DCF?????

Hi roshijerz. You just have to bring you MC and BC to the DFA and get it red ribboned. You can get it after 3 days. It cost 100 pesos per document. I already inquired the last time i went there when get my passport. I have to request another set of MC and BC as my original copy because we will submit the one set of original copy to them.

Oo yep! Yun lang daw according sa kanila nag inquire ako. Yes go and inquire about your passport change of lastname. me, after new year vacation nila!

Hi, I am going to file early next year too but i heard that the rules have changed and DCF regulations are totally different now? Does anybody know more about this?

You got it right tommy and rizza. Yes, even me i have read that when the USC consistently staying here in the PI for 6 mos and above , USC can file DCF...My husband has an ACR card under probationary period and i even emailed them saying he was here for 1 year and a month and responded that my husband can file 1-130 in the USE more faster processing.

Anyway, i sent them another email today and will wait for the respond.

Hi Nieske..What do you mean totally different now? What are the changes they made on DCF? I think it varies country to country?

I will be doing a DCF in Casablanca next month. I am so nervous.

I have been living in Morocco since August 2008 ( Married since 2006) but the US Consulate requires a Moroccan identity card as the sole proof of the 6 month residency requirement and I did not get it until last week. Ugh!

Anyway, I am very nervous and hope all goes well. Morocco is a high fraud country so I dont know what to expect.

Does anyone know how many DCF are denied?

We are trying to get our stuff together to apply in Rome before January but it is possible that we won't submit until January.

we have two years worth of personal stuff, we have a lease agreement, credit/debit cards in both of our names and we will get a few affadavits just to seal the deal :)

Oh ok.. what we have now for proof of bona fide marriage are these, lease agreement ( 2yrs contract conditional), 5sworn affidavits, barangay and residence for each one of us showing we live in one address/house, cards from relatives friends both addressed to our names, joint bank account opened not so long ago, pictures with family,my sss change of status and his under benificiary ,his policy insurance that i am under his benificiary, for 1-130,G32A, red ribboned MC, and CEMAR, authenticated BC, passports mine and husband, divorce decree ,husband's BC, his ACR card.. do you thunk we are lacking something more? What are the original docs that you will submit with the 1-130? And by the way did you already applied for ACR card? Happy holidays to all!

well I think we have everything, NSO cert MC and BC, her passport with my surname, NBI clearance, there was a question about having to have a ACR card as I am here for one year on a balikbayan visa only, at first embassy at Manila said you have to be a permanent resident then I pointed out the law saying anyone that can prove six months of legal residency -

here was my inquiry :

So to clarify, you are saying you will not accept my I130 application

even though I have been a legal resident of the Philippines for the last

eight months but do not have a plan to be a permanent resident , I don't

know what office is in my jurisdiction in the US as my residence is here

in the Philippines, when I move back to the US, if I move back, I may

live in Florida or I May live in Chicago and have entertained perhaps

living in Alaska.

" In some cases, an I-130 petition may be filed for an immediate

relative (spouse, child, or parent of a U.S. citizen) with a U.S.

embassy or consulate abroad. Situations where this may be applicable

include:

If the U.S. citizen has been authorized to be continuously residing

within the jurisdiction of the consular office for at least the previous

6 months"

The way I read this is I have in fact been authorized to continuously

live in the Philippines for the previous six months by virtue of a

special visa extended to IR of a Philippines national why would this

exclude me from making my application for my wife to legally enter the

US ? please provide an explanation so I can understand the process

involved

The Department of Homeland Security/U.S. Citizenship and Immigration Services (DHS/USCIS) office at Embassy Manila only accepts Form I-130 (Petition for Alien Relative) visa petitions filed by U.S. citizens who have permanent resident status in the Philippines or are assigned full time to the Philippines by their American employer.

Non-resident petitioners must file the I-130 visa petition at the USCIS office which has jurisdiction over his/her place of residence in the U.S.

here is the second responce,

USCIS Manila accepts applications and petitions from an individual who can establish residency in one of the countries listed above. Section 101(a)(33) of the Immigration and Nationality Act defines "residence" as the "place of general abode; the place of general abode of the person means his principal, actual dwelling place in fact, without regard to intent." Residency must be established by the petitioner when filing a petition, or by the applicant when filing an application.

I also sent an e-mail to congressman Vern Buchanen to ask for clarification and if Manila Embassy gets to play by differant rules then whats stated as law.

we'll see i guess anyone else have these issues ?
