Ok, I figured out what was going on with me not being able to see the post!

Sorry, I forgot to tell you about the lease and why it was dated as such. The reason was that I actually moved already to my parent's house, but I won't be starting my new job till Feb 15th so thats why we thought it would be better to show the lease to start Feb 1st so the timeline makes more sense, but we are actually going to just edit that lease and make it Jan. 15th, because I moved in early Jan but permanently moved in Jan 16th (had to go back to grab some more things of mine and take care of other things). Plus, I thought saving a few hundred on rent would have been amazing, but at this point that doesnt even matter I guess!

Malrothien suggested I just let the whole Canadian PR issue be and not even mention it in the letter/documents I'm about to send and that seems like a good option too. Is that what you did Malrothien? You just didn't even mention it I'm assuming and obviously it worked out well for you. Please give me details on how to go about this if you can please. I would really appreciate it.

The other option is that I can in my letter just address the Canadian PR issue and nicely state that I can maintain my PR status as long as i'm living with my spouse and not bother with the citizenship mess because technically, it may take over a year to get my citizenship anyway. My husband doesn't want me to give up my Canadian PR status and nor do I want to as it is my right to keep it and I shouldn't have to. I have permanently moved to the US, but I'm sure millions of other people who are Canadian PR status holders didn't give up their status once they moved away from Canada as well and just kept it because you never know when you may use it in the future sometime. Yes I am desperate for my husband to come and join me, but I don't think the CO should feed on my desperation and make me give up my PR status because its something that he personally doesn't like.

The CO the interviewed us (the "Rejectionist"- trailmix and jones know who I'm taking about) seems so complicated to deal with and we just can't figure out what he really wants from us, and I'm assuming he will be the one reviewing the case once I send in the new documents (Right?). I'm trying to cover all bases as I can, but I always feel like he will pull out something new out of nowhere. Im just so frustrated because I've moved to the US away from my husband and I just want to move on with my life like a normal married couple in a beautiful house with a white picket fence in the warm weather of Texas (well not so warm right now).

Lastly, I just want to let everyone know on VJ that they have been a tremendous help, and to excuse me for some ridiculous questions that I have asked and even may ask in the future. Without you guys I think I would've already either gone insane, or probably dug my own grave in my parent's backyard next to their garden of okra and chillis!

Thanks again guys!

Hi,

Malrothien is on a train right now, on her way from Canada to Florida. She decided to move and establish domicile before her Husband had his interview - so she will not have a domicile issue to deal with.

The new CO in Montreal obviously interprets things differently than others do.

You know, I don't know that any of us can advise you what to do here, this is unchartered territory. There was Dalene (now username Lenie7), the CO said this to her:

He told me that I do have several "checks" on the U.S. side of things regarding establishing domicile, but the one "check" on the Canada side, having a Canadian PR Card, prevented him from issuing the visa. At first, he said he couldn't REQUIRE me to relinquish the card, but then later said that without relinquishing it, we wouldn't get the visa issued unless I got a job in the U.S.

They haven't sent their additional info in yet though.

Mal may well be right - since you have already moved back to the States - it may not be worth mentioning - it may now totally be a non issue.

Now that I am off the train for my break in Chicago I will say this:

You have already moved back to the US. The Canadian PR should no longer be an issue as you have physically removed yourself from Canada. However, with that said, I would NOT say anything further about your PR card nor your application for citizenship as it has no bearing on the process for your husband. If they ask about it, answer, but do not go out of your way to say anything further on the subject. Just when you send in your proof, simply state that you have returned to the US due to the domicile requirement and list your proof (which looks good - as someone else posted in their interview review the main key here to proving domicile is financial transactions).

What TM said is true, though. After all of the denials posted here on VJ, we are preemptively beating the horse to death and I am moving back to Florida as we speak.

Hey guys again,

My husband and I were wondering if a letter from his parents stating that I have moved out from their house and that all mail is now being forwarded to my Texas address would help any?

I don't think so, your new lease should be proof enough.

Hello. My husband mailed off the documents along with his passport today. We are all just praying that he will get approved and be able to join me as soon as he can. Will keep everyone updated!

Thanks for updating us neela! Here's hoping that your visa is delivered to you now! (F) Please let us know how this all pans out.

So I officially HATE Canadapost! The package that was mailed was damaged so the Montreal embassy REFUSED to accept it even though the documents were not damaged. The whole thing was sent back to my husband. When he went to Canadapost demanding that htey pay for the mailing off of documents again, they refused. They said their job is to make sure it reaches to the destination and thats it! They wouldn't take any responsibility for the damage that took place! My husband had to dish out more money to send it so it can be in Montreal by tomorrow, but knowing Canadapost, they probably wont have it there till judgement day!

I feel like everything is just going so wrong with all this. I just pray that at the end its all going to be worth it.

How awful that this has added to your stress! Keep your chin up, as best wishes are sent your way to a successful resolving of this domicile issue soon!

OMG! So the package that my husband had to resend which was supposed to be delivered on Feb 2nd hasn't been delivered yet. It says that Item is on hold at the montreal post office at the RECIPIENT's REQUEST?!?!?!?! What does that mean?!
