Hi everyone. I arrive here in US on a k1 visa. I just got married but I did not file my AOS yet (we will file on monday). On the k1 Process Flowchart guides says I can apply for snn after entering usa. I only have one month left on my 90 days I try to get a Social Security Number today but they refused me. They said I need to get I-766 from the DHS or I-551 from the USCIS. Is this true? or should I apply for AOS first? :help:

I think because you got married, you can not get an SSN until you have your greencard.

oh they did not ask me if I am already married. They just ask my passport then look on the computer then refused it.

what should I do now if the I-94 expired? just wait for the greencard? how long does it takes?

I got my ssn after i was married and they sent it with my married name on it. It took quite a while to get it but this was in nebraska, i think all states are different. Some of them you have to push a little more because they dont know that k-1 can have a visa but you cant use it to work. You might have to wait till you have your green card to get it but you can always go back and try to push for it.

got my ssn before we filed my aos. i used my married name and brought my original marriage certificate and of course my passport, and in the ssn form i checked the "legal alien not allowed to work". after 2 wks. received my ssn on the mailbox.

They (person at SSA) is incorrect - if you have more than 14 days remaining on the I-94, you should not have had an issue.

If you have been here less than 76 days they screwed up by not at least accepting the application. You can either go back to that office and tell them to look at POMS section RM 00203.500 C1 and ask for a manager if they still won't accept the application or try another SSA office.

BTW which SSA office was this?

I am having problem with my SSN too. I waited for my EAD first before I applied for my SS and up to now I am still waiting for it. It's been 11 weeks I kept calling them but they said they are still waiting for the INS(USCIS) to send my information . Do you guys have any advise? I am desperate now.

I went to the SSC office about a week after I got married.. which was about 2 weeks after I arrived on my K1. I gave the woman my passport with the visa info and my birth certificate and she told me that they would have to verify my paperwork with the Department of Homeland Security (which would take about 4 weeks) and then they would mail out my card.

It took about 4 weeks and a few calls to the office before they finally processed it. DON'T CALL THE 1800 number. They are useless... call your local office and ask them to check on the status of your application.

side note: last week, I decided I wanted my married name on my card so I went back and had it changed-piece of cake. I had my card in the mail about three days after.

Same with me. I had no problem getting my SSn right after we got married and that was a month after i got here.As long as ur I-94 is still valid you shouldnt have a problem.

They tried refusing me...but I printed out the SSA form here, from the guides on SSN...it is an internal SSA document that clearly states you are eligible. You need to print that form...go back and ask for a supervisor...if not, you will have to wait until you rec've your EAD or GC, whichever you get first. With your EAD, you will still have work restrictions showing on your card...with GC it all gets lifted.

I agree calling the SSA 800# is a waste of time for this. Even calling the local office is a waste unless the person gave you their number to call them, not the office general public number. Best thing is to go into the office, since if you have been assigned an SSN they can't give it to you over the phone.

Thanks for all the help :thumbs:

Before we go we printed everything on the Vj's list but our fault we didn't argue or show that we know k1 visa are allowed to get ssn. The officer we talk looks young and new maybe he don't know much about k1. We don't know my situation happens to other members here. On monday we will go back and try to push them. Hopefully we can get other officer than the first one we talk if the same young guy we might look for other ssa office. The first office we been was in Greenville,Tx.

In any event, once your AOS application is received by USCIS and you have their notice of receipt, that notice is evidence that you are here legally pending action on the AOS. After that point, the I-94 is not needed. Once you get your work permit (EAD) -- within 90 days of filing -- you can take that to the Social Security office and they will process your SSN application. The SSN is of no value without the EAD or green card.
