Hey there,

I was wondering if someone could help us out:

Our situation:

My husband (USC) has been involved in a volunteer work for the past three years and as such does not have any income to declare for the I-864. He has some assets but not enough to meet the 125% poverty guideline requirement. I understand that even if he has no income, he still needs to file the I-864.

My father-in- law has agreed to be a joint sponsor for us as he alone can meet well above the poverty guideline. My husband and I will be living with his parents at their residence (there will be four of us living at this residence - my husband, myself, his dad and mom) so now I am wondering does my father-in-law have to fill out the I-864A because we will be living in the same household? or can he just fill out the I-864?

Any help would be greatly appreciated!!!!

If your father-in-law currently resides in the same household as the petitioner (your husband), then he will fill in a I-864A.

If they live in separate households, then your FIL will fill an I-864.

Your husband, being the primary sponsor, will have to fill in the I-864, regardless.
