I just recently received a letter from the IRS that I owe them some money. Would this affect my petition, my fiance is scheduled for an interview soon and I am about to send her my income document.

It will NOT affect your petition. It COULD affect your visa approval at the consulate. Sort out your problems with the IRS and get a payment plan in place BEFORE they apply a tax lein. If this "letter" says they have already applied a a tax lein, then here is what will happen...the amount owed will be deducted from your annual income for calculating your affidavit of support, if this drops you below the guidelines your visa could be denied.

Do not go into this being crossways to the IRS, they are NOT good people to owe money to.

Not that I suggest this this...BUT you would be better off charging the money owed to the IRS on a credit card at 30% interest and then stiffing the credit card company. That would have NO effect on your visa process...ever. The IRs just has too many ways to collect on their debts and use all sorts of strong arm tactics not available to anyone else, they are the last people on earth you want to owe money to, they WILL collect or they WILL find a way to jam you up on something until you roll over and play by the rules. If Osama Bin Laden owed $6.34 in past due taxes we would have caught before Oct 1st, 2001.

Laugh. Then the govt. will come in and bail out the credit card company.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

That doesent work anymore either... I had a friend who tried to do that, put the IRS amount on a Credit Card then file bancrupcy... However, the Judges now do not charge off that amount that was paid to the IRS... You end up getting the bill back WITH interest!!!!

I'm looking for more evidence to the post about people have been stopped at the border and had their passports seized because of tax liens? I know the Wesley Snipes case but I never heard of that happening to anyone. Since when can the border scan your passport and poof it says WANTED BY THE IRS! ? (maybe off topic - sorry)

I never suggested filing bankruptcy which will NOT work (in and of itself). I said you can STIFF them for it, just do not pay and do not claim bankruptcy. Unless it is a a large amount the credit card companies will do nothing but call you for a few months, mark up your credit and basically do nothing. They cannot. It is unsecured credit and they have to pursure judgements, etc. The IRS just outs thw word out, blocks up your tax refunds, student loans, visa applications, etc. until they get what they want. They don't need a judgement or anything, they can garnish your wages or bank account without a judgement. Credit card companies cannot do this. Stiffing a credit card company will NEVER EVER affect the visa process, stiffing the IRS will.

Christeen was talking about what the bankruptcy judge ruled.

That's a bit different than what a credit card company can and cannot do.

Contact the IRS , if you don't have money tucked away they will set up a payment plan. Then tend to want it paid off quickly so they will suggest an amount that makes things tight money wise. However if you have a payment plan established you should be ok with immigration.

This will not be over quickly. You will not enjoy this.

Good advice, BUT...

If a lein has been imposed BEFORE a payment plan is in effect it will make no difference.

You need to understand that the affidavit of support is so the government is assured they "get theirs" in case your fiancee does a runner and turns out a welfare queen. They DO NOT care about her well being or yours. They can trump ANYone except the IRS on your funds, income, assets, etc. which is why they do not care if you are up to your eyeballs in debt or have bad credit. Since the IRS is the ONLY one that gets in line in front of them, any IRS leins have to be "deducted" from your income.

If you need to make $18212 per year to qualify, for example, and you make $25000, but you owe the IRS $10,000 (even with a payment plan in place against a lein) they will consider your income to be $15,000 and your visa is denied. If you make $85,000 per year and owe $10,000...no worries.

If a lein has not yet been imposed, then you can head them off at the pass with a payment plan. Once the lein is in place it remains until it is PAID IN FULL.
