Hi guys!

I have a question.....maybe silly but important for us. Me and my husband are filling for Adjusment of Status. I need to know if we need to fill again, another form of the I-134 (need to be certify by a public notary) and also if i need to fill it out with my new marital status and my new last name?

And what's the A# that is required in some of these forms?

Hope you can help us with all this questions.

For AOS, the sponsor must complete an I-864 (not I-134) which does not require being notarized

and also if i need to fill it out with my new marital status and my new last name?

Yes - most folks do. I don't know if you are the US citizen or not, but assuming you are not; when filing AOS (and EAD etc) and you did change your name, now would be the best time to use your new married name.

And what's the A# that is required in some of these forms?

its not the same affidavit!!! Look at the guides I-864 is for AOS. K1 is I-134 its NOT the same forms!

Many of the data will 'carry over', but it's a different form altogether.

If you are in 'current tax year' for the I-134 and your employment hasn't changed, then ya, simply put all from the I-134 onto the I-864, along with da tax forms, tax transcripts, assets (if used) , and the employment letter.

Pay attention, though - if you skimped on the I-134 - its a bit more data on the I-864.

just didnt realise they were different because I hadn't actually got to doing it - partly because I won't be doing it at ALL, because my father in law is my sponsor. He didn't skimp on any info, we have 2 lots of photocopies of the original Aff of support and all tax forms etc (which i was informed about afterwards.. !).

You're here on a K1. The petitioner needs to fill in the form AS WELL AS the co-sponsor. You will get an RFE if you do not include the petitioners information as well.

You should be fine with just the 2008 ones (IRS transcripts mean you don't need the tax return or 1099's or W2's). That's what we'll be doing. I think after the "deadline" for W2's having to be sent out they might expect 09 a little bit after than but for you right now, no I think you're fine.

You have until April 15, 2010 before your "most recent tax return" has to be the 2009 return. If you file before April 15, you can certainly use the newer return, but 2008 is allowable until the filing deadline.

Also somewhat related, once the poverty guidelines for 2010 are published, then the level of income for the new guidelines must be met, which will likely be higher. That normally happens by mid February. They are issued each year in the Federal Register by the Department of Health and Human Services (HHS).
