We are looking through the form I-130 section 22 and this is what it says...

22. Complete the information below if your relative is in the United States and will apply for adjustment of status.

Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in: _________(City)____________(state)

If your relative is not eligible for adjustment of status, he or she will apply for a

visa abroad at the American consular post in: ___________(city) __________ (state)

So my question is...does this question apply to me at all...as I am living in Canada...and my husband is a USC whose filling out the forms...I am not in US and I will not apply for AOS etc...I know this doesn't apply to us...and we should put N/A on both parts of the question ...but my darling husband wants a confirmation!...so please advise!!

We mailed our I-130 to the lockbox on December 30th as well. It was delivered Jan 2nd. Does that make us December or January filers? lol

I filled out the second part...your relative is not eligible for adjustment of status and put the consulate where she is at since she is not in the US. Check out the example form here: http://www.visajourney.com/examples/INS-Form-I-130.pdf

Hey Canadianggal - will the notice date appear on the letter we get back? At this stage, the I 130 was mailed and delivered but the cheque hasn't been cashed and we've not received anything via the mail.

Well we got email notification today that our file has been sent to the California Service Centre and that the official I -797 is being mailed out. So NOA1 is happening and we are officially January filers !!

Not to my knowledge. I check mine pretty frequently but I expect that they got busy and paperwork is probably piled high from the holidays.

Let me know if anyone else gets a update on their case

Same here... no update yet on our case. it has been a month and 3 days and still no "touched" until now ... I've been checking everyday on the uscis website.

I'm a bit late posting, but the wife sent in our I-130 on the 11th of December, and received the NOA1 on the 21st.

I'm not the most patient person and this waiting is killing me..

I check my case everyday, have received no new touches yet. According to Igor's list they are working on September filers now, so around february we should all be gathering documents needed for NVC stage just to have everything ready.

looks like september filers are recieving their NOA2's which means we will probably get ours in April.
