What was denied was the I-129, right? I don't recall you guys having your interview yet.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm sorry that this happened. I agree with the member who said call you congressman, maybe they will be able to help and it won't hurt anything at this point. I hope it was a mistake on their part and it can be cleared up soon for you both.

I just want to know if once you're denied the 129F, can you then just get married and then file a CR-1 instead??

You can, but if the reason your I 129f was denied is not overcome, success of the CR1 is certainly not guaranteed.

I am sorry to hear that (F)(F)(F) i noticed you got RFE 8/24/09 and you replied 10/1/09?...that may be why they normally reqiure a reply in 30 days if they get it afterwards they will deny your petition :unsure:

Agreed - this could likely be the culprit. In which case, marrying and starting the I 130 process would likely be easier than trying to challenge the I 129f denial.

What is the deal with keeping information from the applicant and petitioner? When they deny an application they know already "whats wrong" , so why not tell us right away? Why leave the couple wondering for days even weeks, consuming time that could be used to appeal or choose another course of action. Aren't we supposed to get a reason for denial slip anyways?

Sorry. I should have told a little bit more. It was our 129F that was denied. When they sent our RFE, it gave us until October 2nd to get it back to them. I'm assuming they gave us until October 2nd because in our application, I explained to them that where Manuel lives does not have mail service. So, it is hard to get things back in a timely fashion.

We recently got in touch with our congressman to try to check on the status of our case.(Because it was outside of the processing time) They gave her a generic answer. They will not tell her why it was denied, just that it was. They say we will have to wait on the letter. But, that's okay. We will just do whatever we need to do to either refile or appeal.

One things Manuel did point out is that they needed our response by the 2nd of October. They did receive it on October 2nd. (We have signature and date/time) But, there system shows October 6, 2009. It would be nice if it was something that simple!!!

Again, thanks to everyone for everything !!!

Try your senator. When we were denied my congressman didn't do #######. Senator did tho.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
