I'm lost. I brought my fiancee from Ukraine on a K1 visa. We were married withing the 90 days. So now I need to file the 485 and 765 for her.

We want to bring her 18 year old son here in July.

1. Do I file an I-824 for her son when we send in the other paperwork?

2. Her visa already expired, is it too late to get her social security card until her EAD arrives?

3. On the 824 does my wife's or her son's info go in Part 1?

4. What goes in Part 3: 1 and 2?

For proper assistance please fill in time line. She did have her son listed on application right?? :unsure: There is a 1 year limit on child to follow.

For proper assistance please fill in time line. She did have her son listed on application right?? :unsure: There is a 1 year limit on child to follow.

Her son was on the visa application. It was approved in Aug. She arrived in Aug and we married in Aug.

For item #2 - she can get a SSN if she has the EAD or Green Card. After the visa expires (or within two weeks of expiration) the Social Security Admin. won't give her a card. With an EAD she can get a conditional card that will be good until the expiration of the EAD, then after the GC comes, you fill out the same application to remove the condition. There will be "for work only" on the first one - but it works for everything. That is basically the process we went through. Good luck!

You can get a K-2 to follow within one year of her K-1. Calll the consulate when you are ready and make an appointment using the same NVC number as you did for her. If her son was listed in the K-1 it is not a probem. If you want him here in July, make the visa appointment for any time after February, 2010.

Her I-485 does not cover him and you will file a separate I-485 for him when he arrives.

We did botha K-2 and a K-2 to follow for our 18 year old son. Very simple and straightforward.

he is 18...you will need for the visa interview, in ADDITION to ALL the things you needed for your wife...

1. His military registration and student (or other) deferrment, translated

2. Letter from you accepting him to the US.

3. Copy of your wife's green card, or filing reciept for AOS, copy of your marriage certificate and copy of the original petition approval (NOA2 as it is called)

he also needs ALL the same other things your wife needed, visa application, police certificates, passport photos, medical exam, yada, yada and will file a separate I-485 when he arrives. All fees apply to each person individually.

No. This rule applies to immigrant visas (CR-1, IR-1) it DOES NOT apply to non-immigrant K visas. He MUST file for his AOS before he is age 21, that is the only restriction for a K-2

Absolutely correct. This is a quirk in the system. One of the rare instances where it's better to be the child of a foreign fiancee than the child of a foreign spouse.

It can also be a valid and very good reason to choose the K-1 over the CR-1 in cases where the fiancee has children over 18 who wish to come also.
