I dont know who to believe! Just called US Emb in Madrid

Hi!! I as I said before I called US embassy here in Madrid, Inmigration section lady said Yes u can apply here even being illegal here, I know u can´t get your Spain Police Report, but we do it internally, she said they don´t care my legal situation here, so she told me my husband should change the interview address here to Spain. She also told me I should do it here since Im living here the past 4 years!! Then I called NVC and an operator told me NO, U can´t get an interview there being illegal, I explained her I can get my Resident card but is gonna take me maybe a year, long process, and I also told her that the embassy in Madrid told me Yes I can and I know some other people did it in the past too! so she said.. Send us letter.. from US embassy in Madrid, telling that u can apply being there illegally. Then I called back to the US embassy here to try to talk with this lady again but .. I couldn´t find her anymore, I have to call Tuesday , then I called VISAS section, and a very rude guy told me.... again.. NO u can´t if u r illegal here!! so I dont know who to believe!!!

I know a poster that got this same situation, her fiance applied for a K1 visa, he was illegal here, and he got his visa! now they r happily married in the US, so they could do it! Im trying to contact to her but I didnt get any answer yet!

I dont know what to do , for now Im gonna wait until tuesday to call again, then wednesday im going there to get more information.. Im so lost!!Im gonna try to keep calm until next week. but it gets my nervs when someone says YES, other says NO.... :bonk:

I need my husband!!!! :huh:

This looks like one hand doesn't know what the other is up to.

(typical govt. snafu)

Maybe it's time for your fiance to contact his congressperson,

but in the meantime ask to speak to a higher supervisory person

at the consulate or go see one your self with a personal visit.

Only the US govt. can give you a definitive answer; even my

previous answers were at best "educated guesses" as well

as all the other ones. Even a successful VJ menber in the

same situation as yours won't be a guarantee.

I guess the difference is that the other poster was doing a K1, so they didn't have to deal with the NVC.

I am rusty on the requirements for the various visa types. Why does the NVC need to know of your immigration status in Spain? Is it because they process the police certificate when you're doin a CR-1? Is it too lateto drop the CR-1 and do a K3? Would that eliminate the NVC's involvement?

Hi! There is no difference, they went throught NVC too, she said they didnt do anything special, he just gave a permanent address in Madrid to get his mails, from NVC, and he got his interview here.

She told me even not to hear NVC and forward my address here in Spain... Im losing my hair because of this situation!!! :angry:

Yes , that is exactly what Im gonna do, Im gonna call again next tuesday and Im going next day, wednesday, I need an answer!! but a correct answer!!!

to finally decide what should I do.!!

This is a CR-1 visa, not fiance, the K1 visa I talked about before was someone who went throught this same situation and this guy was able to get his interview here, being illegal, he got his fiance visa and he was aproved here in Spain, now they both live there.. as every marriage should!! TOGETHER!!

Jenn, when we did DCF in Montreal, we both had to send in proof of legal residence in Canada. I would assume this could be a similar request. In the case of Canada, you have to prove legal residence or they won't process.

You're right. It was the consulate -we did not go through NVC since we did DCF.

I'm not sure why you are talking to NVC about it; it is up to the Consulate (Madrid) if they will take your case or not.

I know you keep describing yourself as 'illegal' but what I read of your past posts doesn't sound like you are 'illegal'. You have been resident in their District, they (Madrid) said they would take your case... your I-130 should say 'Madrid' on it. The NVC doesn't really make this call.

I think you are maybe making this more complex than it needs to be.

I think you are maybe making this more complex than it needs to be.

Unless NVC won't give a case complete without it... I think someone suggested the K3 as an option... Might want to spend the waiting time researching that option, just in case...

With any luck, though, NVC will give a case complete with the letter that Durdin sends in and then it will be up to the embassy... Just hope you get the first guy processing the case instead of the second guy :)

Anyway, you have a few options IMHO:

1. Keep plugging away the way you are going and see if you get a case complete then go to the embassy.

2. Go back to Bolivia and try to procure a Spanish PCC from there. Then return to step 1.

3. Abandon the IR1/CR1 and go K3, circumventing the NVC.

4. Get a lawyer to help with the process.

5. Durdin joins you in Spain until you can obtain a situation where you can get through the process unscathed.

6. You and Durdin head to Bolivia until you can obtain a situation where you can get through the process unscathed.

If it were me, I would continue trying to get the case through NVC as is while exploring the possibility of the other options I mentioned (probably first looking up immigration attorneys here in the US and in Spain who could at least give me some professional advice on home I might proceed). Just my 2 pesetas, errrr Eurocents...
