I am trying to find out what documents need to be included in an application for a K3 visa if I've already filed a CR1 application and received my NOA1. I am not quite understanding the directions on what constitutes an "item" in the instructions for the I-129F. For example, do I have to complete the G-325A again, send pictures, etc.? Also, I am reading the instructions that I do not have to pay the $455 to file for the K3. Is this correct?

You don't need to pay the $455 but I would also say don't file for the K3, it will delay where you application is right and is more costly in the end.

You don't need to pay the $455 but I would also say don't file for the K3, it will delay where you application is right and is more costly in the end.

I don't care about the money but in what way does it delay the application? Can you provide more details?

When the I-129F for the K3 petition is received it is grouped with your CR-1 application. Now the grouping does not mean putting the K3 where the CR-1 already is in the pile... it means taking it out of it's place and putting it in the back of the line as if this is a whole brand new petition.

We filed for both the K3 and the CR-1 and K3 did not save us any time. Our interviews were scheduled so closely for the two different visas. Thank god we were able to interview for the CR-1 and he entered on that one. It gives you a greencard upon arrival and he was able to work. K3 is a lot of additional hassle... definitely not worth the time and money. Had the processing been done the day he interviewed for the K3 it would have only saved us 2 weeks.

I know 2 weeks sounds like a lifetime at this point, but think big picture and what will be best for your husband once he arrives.

Your receipt date was 10-28 by your timeline. By the time you send in an !-129F and it gets receipted you will have lost almost two months of processing times.

I would suggest studying the shortcuts listed in the CR1 area and the lingche shortcut in the VJwiki.

Just a few reasons why to go with the CR-1. If you are eligible for a IR-1 then you would be nuts going with a K3!

The K3 has to adjust status which cost $1010 + $131 visas application fee.

Have to go thru the cost and hassles of getting a I-693 also.

K3 normally has to do biometrics and have a AOS interview. Time off from work cost the petitioner. PLUS the hassles of submitting the paperwork and going for the interview. Tain’t fun.. Especially if denied or questioned. Ever done a Stokes interview?

That’s the second interview if they are in doubt of your relationship.

Also a possibility of being deported. Yeah doesn’t happen much but it happens.

K3 has to wait about 90 days after they file to get EAD or GC so they can get SSN and be able to work.

CR-1 can work as soon as they get the GC and SS card in the mail. Normally with 6 weeks.

Can’t do a LOT of things without SSN. Like work or get a drivers license in some states.

Some K visas don’t get GC for a LONG time.

If petitioner goes belly up before you get GC you stand a chance of being deported.

If the petitioner loses his/her job after the interview you don’t have to worry about getting a co sponsor to adjust status!

CR-1 cost about $470

Get their GC and SS card in the mail within 6 weeks of arrival.

No biometrics , dealing with civil surgeons, AOS interviews, going to SSA for SS card.

I’m sure I’ve missed a few things.

Bottomline is anyone that goes with the K3 the way things are now are masochist!

Yeah I did but at that time K3s were a LOT faster. That’s not the case anymore.

And yes you do have to duplicate all the paperwork and submit that you did with the I-130.

You may want to update your paragraph to include:

CR-1s can work as soon as they get the SSN (unless they already have one, then they can work straight away). The endorsed visa serves as a temp GC until the real card arrives.
