Hey Guys plz Help me out !

My Mom's mother (nani) Kept file for my mom and me (i was 14 yr and 27 days) on 23-11-01 . Its F3 File .

File was approved on 20-7-06 (It took 4yrs and 7 months to approved).

My Date oF Birth is 26-10-1987.

So does CSPA applies in my Case ?

You need to know;

1. The Priority Date on the case

2. When the I-130 was approved.

3. When the Priority Date becomes current

Ya i used Calc, i got YES ans.

I just got Choice Of Address and Agent Letter on 2nd dec (in calc i just assumed date of I-130 approved date). So i want to know that CSPA Vill be apply in my Case or not ? And if Yes than how shld i Proceed ? and how shld i prepare For future ? Is anything abt to worry ?

You cannot assume that the day you go the Choice of Address and Agent is your day of approval. That's is absolutely incorrect. Your approval date is way before that. Your approval date is the on the 2nd notice that the petitioner would have received. That notice informs the petitioner that the petition was approved and being forwarded to the NVC to await for an available visa. After a long wait at the NVC, you get the Choice of Address and Agent letter.

You can't make up a date that you think the petition was approved and then ask how to proceed. Do step 1 and then go to step 2. You can't skip 1 and then ask us how to proceed. We don't know because you didn't answer 1 correctly.

I think i miss understood, sry 4 that . . . The details are as under:-

1) My Category is :- F3 - Married Sons & Daughter Of U.S Citizens. (My mom's Mother Kept File 4 my mom)

Priority Date :- 23rd Nov 2001

2) Application Approved Date :- 20th July 2006

3) Choice Of address & agent letter :- 2nd Dec 2009

4) My D.O.B :- 26th Oct 1987

CSPA most likely will apply to you. Use the CSPA calculator (see the link in my earlier post to you). You should wait to see if you are listed on the AOS and IV fee letter. The petitioner should receive that letter in the next few months. If you are listed, then there is nothing for you to do to invoke CSPA. If you are not listed, then the letter tells you exactly how to contact the NVC about CSPA. Wait until the petitioner gets this letter to proceed.

If you are impatient, then google "contact NVC" to find out how to contact them. You could contact the US Embassy too, but at this point it's the NVC that you would need to deal with. You may not getting very far with this if the NVC has not sent the beneficiary the AOS and IV fee letter.

I have 1 more doubt, is that when i got choice of agent letter. There is 1 more letter, I think its AOS and address verification letter. It on my mom's name. It say as under

Than at last it is written that "You must pay affidavit of support (AOS) fee ($70.00) before we can being processing your petition" So it is AOS letter i think

Than on another page "Important Notes" are given

1 and 2 point - is ok and i understood

3 . Children who pass 21 years of age after the petition was originally approved by the USCIS become ineligible to accomplany or join the applicant(s) immigrating to the United States under the original petition. In Some situations, the Child Status protection act (CSPA) may allow Children to remain eligible beyond 21 years of age. if you belive that CSPA applies to this case, please send a detailed explation to the NVC. we Will Forward it to U.S.Embassy/Consulate General for a decision.

You have done the calculation. The NVC has informed the petitioner and beneficiary on how to invoke CSPA. What are you confused about? Just follow the instructions in the AOS and IV fee letter.
