Hello, i got a question about Taxes.

well i never worked, but my spouse added me on the taxes papers, as DEPENDENT .. so do u think i should to send the last 3 years of tax papers to USCIS when i apply for my Citizenship ??

Technically, you are not a dependent but a spouse filing a joint return with this box checked, "Married filing jointly (even if only one had income)". And for exemptions, "Boxes checked on 6a and 6b" the number 2 following that. This is what the USCIS would like to see. The dependents follow that are normally your children or other qualifying dependents.

Technically the lines "Your first name and initial" and "If a joint return, spouse’s first name and initial" should be all what your IO should need to see, but my wife told me her IO went page by page, she was nosy. It doesn't make any difference if you are working or not, but getting rare in todays economy, mommy use to stay home with the kids.

A spouse is NEVER a dependent for tax purposes. See here:

And scroll down to where it says "Your Spouse's Exemption". The paragraph has one sentence, "Your spouse is never considered your dependent".

If you mean instead that he claimed your exemption, then the two of you should have filed as married, filing jointly. That would probably have been the most beneficial way to file anyway, especially if one of you had no income, because the tax rates are lower.

Anyway, if the two of you filed joint returns, definitely send them in, just like the M-476 checklist tells you to. In fact, follow the M-476 checklist regardless of how taxes were filed (but if they were filed incorrectly, you may want to see about filing amended returns). The fact that you personally show no income on the joint return doesn't matter.

4. Documents referring to you and your spouse:

• Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or

• Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or

• An IRS tax return transcript for the last three years.

So you might want to send transcripts instead of the returns themselves, but if you're applying based on marriage, they'll want you to send the tax information in one form or another.

It's probably best to go through that entire document checklist at the back of the M-476 in detail to make sure you've got everything they want.

A transcript comes from the IRS government office. You can order them by calling 1-800-829-1040. They're free. They're smaller than your actual return, because it's a computer printout without all of the text and blank space that's on a printed return.

Oh Thanks again i guess i am going to make a copies of my 1040x Tax return and send them

They do want the last three years with copies of your W-2's and 1099's though I don't know why, ours had the IRS label on them showing both our names as filing a joint return. I also tossed in four years, as a hint to how slow our processing was, but wife's IO only wanted three.

A friend had problems with the conditional as he didn't have his wife on his home deed, let him go on that as he brought in a letter from his bank showing he would have to pay a bundle of money for refinancing and a copy of our state statues showing when married in this state, the house was half her anyway. Then they had to go through the same thing again for USC. My home was paid off, but didn't want to pay an attorney 500 bucks to add her name, so working with my register of deeds, did it myself, the big problem I had was finding the form, but found that, only took a couple of minutes to fill it out, and only cost me ten bucks. But they still wanted that utility bill besides everything else we sent in. You don't know what to expect from your IO.
