My I-130 has been approved for over 18 months but my change of status is still pending clearance of the background check.

I have been in-front of the judge 4 times already and each time immigration lawyer (ICE) says "we don't have clearance your honor" and then I get another court date. My wife is here in US (she is citizen) and we live together but how long this clearance supposed to take?

Please share your experience and thoughts since I'm about to loose it. :angry:

I also have been recommended to write a mandamus. Any good lawyers in los angeles area you might recommand?

It happened to one of m friends too, he sue USCIS for unspecified damages and a month later they asked him to do another Biometric test and week later he had an interview and he got approved

why did you have to go in front of judge? did you sue them too?

do you have very common name?

when you say your I-130 has been approved 18 months ago, what do you mean of that, do you mean you had interview with USCIS and they said you are approved or you just had your Bio?

how did you come here? I bet is is not K1 or K3?

There is a long story behind this... few years ago, this lawyer's assistant "Bahram Tabatabaee" helped me with my green card. He made up a story and then changed my name for faster processing. I had no idea what he was doing since I was speaking the language and I was naïve. I got approved within 2 months and I was very happy but 1 year later USCIS revoked my card and put me in removal processing for fraud. I had to hire another lawyer "real one" to take me out from this mess. Then I got married and now I see judge for change of status and hopefully closing the fraud case and approving my I-130 with my citizen wife.

I got married in October 2007 and soon after we had an interview and it was approved. We are processing this case but the old removal case is also still open. When I get clearance, then judge will close the other case "hopefully" but we don't get any clearance...

you said is a long story behind this!! if you want any help you may want to start from the beginning.

Name Change is not fraud and any one can do it, unless you tried to make a brand new identity for yourself which that is fraud, no matter if you are married to a US citizen or any one else.

if I'm not mistaking I-130 is for K3/CR1 and and you needed to file I-485 for AOS.

but still I don't know the details of you coming to the US and staying here and your legal status from the beginning of coming here and staying here?

did you over stay your legal status at any time?
