Hello All,

My wife is under "Conditional GC" Until we file to lift the conditions.

I wanted to know if she before lifting the conditions of her GC can petition for siblings or parents.

Or she has to be a LPR or a US Citizen to do so.

No, she has to be a USC to petition family members.

She is already a LPR but she has a condition on her green card - to remain married to you. After she lifts that condition with you (filing I-751) she will receive her 10-yr GC.

Wait time for parent - around a year for everything to go through.

Wait time for a sibling from PI - around 24 years.

A Legal Permanent Resident can only petition for a spouse or unmarried children. Only US citizens can petition for parents and siblings. No one can petition for in-laws.

For Filipinos, it takes a USC about a year to petition for a parent and about 23-24 years for a sibling. A petition for a parent is an Immediate Relative case and the only person who can get a visa is the parent, meaning that minor children of the parent are not included in the petition even though they are listed as children in the petition.

do you mean you got your GC in the mail? if so, as soon as you have your GC you can file for her anytime.

You have to seen in a copy of the GC with the i130. She cannot marry until after you become a USC. she has to stay unmarried for now or the petition will be voided, since LPR cannot file for married children.

LPRs can only apply for spouses and unmarried children.

And this is just me but sheesh, impatient, much? Your wife has only just entered the U.S. -- now she wants to bring her entire family over?

Hello All,

Once your wife becomes a USC (she can apply after 3 years as an LPR and 3 years of marriage to you, the USC), then she can petition for her parents and siblings.

It will take her 23 years to petition for her siblings. So, its 3 years (US citizenship for your wife) + 23 years = at least 26 years before her siblings will be eligible for visas.

It will take 1 year to petition for her parents. So, its 3 years + 1 tear = at least 4 years for her parents to immigrate.

After her parents become LPRs, they can only petition for unmarried children. It will take 11-12 years for these children to get visas and they cannot be married during this waiting time. So, its 3 years (US citizenship) + 1 year (parents) + 11 years = at least 15 years for siblings who are unmarried during the entire time the parents are petitioning for them. If the petitioning parent dies, so does the case.

If her parents become US citizens; 3 years (wife's US citizenship) + 1 year (petition parents) + at least 5 years (US citizenship for parents) + 17 years to petition for married children = at least 26 years.

I understand your wife's desire to help her family. However, it will be a very long wait for her to petition for anyone aside from her parents. Sorry.
